MINUTES <br />CITY COUNCIL <br />AUGUST 30, 1990 <br />The City Administrator reported that it is the <br />recommendation of the City Attorney as well as his own <br />that the indemnification clause for claims arising from <br />hazardous materials be eliminated from the contracts <br />for both the Fire Station and City Center projects. <br />The architect was to have eliminated this clause, <br />however, it was not taken out of the contract form. <br />The Administrator recommended that any bid award be <br />contingent upon the contractor agreeing to removal of <br />this clause from the contract. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 90-8-400 - ACCEPTING THE RECOMMENDATIONS <br />OF THE CONSTRUCTION MANAGER FOR AWARDING, WITHHOLDING, <br />OR REJECTING BIDS FOR THE NEW FIRE STATION PROJECT AS <br />PRESENTED IN HIS REPORT DATED AUGUST 30, 1990 SUBJECT <br />TO REMOVAL OF THE INDEMNIFICATION CLAUSE FOR HAZARDOUS <br />MATERIALS FROM ALL CONTRACTS FOR THE FIRE STATION <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (5) Scalze, Fahey, Collova, Blesener, LaValle. <br />Nays (0). <br />Resolution declared adopted. <br />Beckwith then began a detailed review of the bids <br />received for the City Center expansion project. <br />Beckwith recommended that the low bid be awarded in all <br />areas except the following: <br />Lawns & Sodding - Beckwith pointed out that only <br />one bid was received, and recommended that these <br />items be rebid with the Landscape Package. <br />With regard to landscaping, Beckwith pointed out that <br />there are some existing trees on both the Fire Station <br />and City Center sites that could possibly be saved by <br />relocating the trees. Beckwith requested that Sanders <br />& Associates be authorized to determine which trees can <br />be saved and are economically feasible to move. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION NO. 90-8-401 - AUTHORIZING TAE CITY <br />ADMINISTRATOR TO WORK WITH SANDERS AND ASSOCIATES TO <br />DETERMINE THE TREES THAT ARE ECONOMICALLY FEASIBLE TO <br />SAVE ON THE FIRE STATION AND CITY CENTER SITES THROUGH <br />RELOCATION <br />Page 4 <br />
