MINUTES <br />CITY COUNCIL <br />SEPTEMBER 12, 1990 <br />footings of a bridge on the Sleepy Hollow property', <br />caused damage to trees in the drainage area resulting <br />in the removal of 42 trees. Norris reported that the <br />pond was very close to overflowing during the storm and <br />Sleepy Hollow had great concern that its first-floor <br />units would be flooded. <br />Norris reported that the present owners purchased the <br />Sleepy Aollow property.in 1985. Over the last few <br />years the drainage area running to the pond has become <br />filled with trees and roots and the owners have had <br />this area oleaned out. <br />Shirley Lovell, manager of the Sleepy Aollow complex, <br />reported that the barrier around the pond has eroded <br />and needs to be built up. Norris agreed. <br />Norris reported that the owners of Sleepy Hollow are <br />askinq the City to accept the culvert and run-way area <br />to the pond and maintain this area. The property <br />owners would provide the necessary easements to the <br />City. <br />Fahey commented that the drainage of the Sleepy Hollow <br />property has been a difficult one for the City. In the <br />early 1980's the City addressed the drainage pr,oblem <br />and got the cooperation of the owners of the property <br />contributing to the problem to put in a drainage <br />system. Fahey questioned why the easement for the <br />run-way area was not obtained at that same time. <br />Lovell replied that it was her understanding that the <br />then owner of the Sleepy Aollow property refused to <br />grant the easement. <br />Fahey stated that some research was necessary on the <br />part of the City as to the easement question. <br />Norris stated that the easement would be for <br />maintenance of the run-way area. <br />Fahey stated that it may be that the City did not want <br />to assume the responsibility for maintaining this area. <br />Scalze pointed out that the drainage improvements were <br />put in as a private project. <br />Lovell reported that the current problem arose after <br />recent heavy rains when the Grand Pre' pond overflowed <br />and drained into the Sleepy Hollow property for three <br />days. <br />Page 11 <br />
