MINUTES <br />CITY COUNCIL <br />5EPTEMBER 26, 1990 <br />PROVIDE FUTURE ROAD ACCESS TO THE FRED SCHLETTY <br />PROPERTY, AND REQUIRING THAT THE DEVELOPMENT AGREEMENT <br />THAT THE CITY WILL ENTER INTO WITH THE DEVELOPER OF THE <br />FREDRICKSHAVEN PLAT INCLUDE REQUIREMENTS FOR <br />REPLACEMENT OF LANDSCAPING, ETC. FOR THOSE PROPERTIES <br />ALONG SUNRISE DRIVE WHICH ARE AFFECTED BY THIS <br />DEVELOPMENT <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Blesener, LaValle, Scalze, Collova. <br />Nays (0). <br />Resolution declared adopted. <br />PRELIMINARY Scalze opened the Public Hearing to consider approval <br />PLAT - of a preliminary plat for Costa Estates. Scalze <br />COSTA ESTATES pointed out that this issue was before the Council <br />recently, however, the preliminary plat has been <br />revised and is being resubmitted. The revision <br />includes the proposal for the extension of Costa Lane <br />(formerly identified as Noel Drive) from Allen Avenue <br />south to a point approximately 800 feet south, the road <br />then turning west and connecting with DeSoto Street. <br />The Planning Commission recommended approval of the <br />preliminary plat by a vote of 4 in favor, 1 against, <br />and 1 abstaining. Scalze noted that the Park <br />Commission has not yet reviewed the proposal. <br />Jack Clinton, attorney representing the Costa family, <br />appeared before the Council. Clinton pointed out that <br />the previous preliminary plat proposed 48 single-family <br />lots, and the one before the Council this evening has <br />44 single-family lots. Also, the road configuration <br />has been changed as described by Scalze. Clinton <br />reported that the lot sizes proposed comply with the <br />City's subdivision requirements. <br />Scalze asked if there has been any progress for the <br />acquisition of easements to Al1en Avenue. <br />Clinton reported that the Costa family has not <br />proceeded with that. Clinton stated that it was his <br />understanding that the acquisition of any property <br />necessary for road right-of-way would be accomplished <br />by the City and the costs included in the project <br />costs. <br />Scalze stated that she was not sure the City gave any <br />assurance that the City would acquire the road <br />right-of-way, and it was pointed out that it would be <br />less expensive if the developer were to acquire this <br />property. <br />Page 8 <br />
