MINUTE5 <br />CITY COUNCIL <br />OCTOBER 10, 1990 <br />the Fire Station construction and 8% for the remodeling <br />of City Center are not generous, and there was no room <br />for any latitude. Kroos reported that his firm has <br />spend a lot of time and effort on the two projects and <br />have given the City a lot of service. Kroos reported <br />that when the contract was being negotiated, a base bid <br />amount was established plus the lower parking lot at <br />the fire station was established as an alternate. Now <br />that parking lot is included in the base bid. There <br />was also an adjustment on the interior wall at the fire <br />station. On the City Center project, bricking the <br />outside of the building was an alternate. <br />Fahey pointed out that it was clear that the direction <br />the Council gave was for a minimum number of <br />alternates. Fahey felt the City used good judgment in <br />putting together a total project, minimizing alternates <br />that the City would have to pay additional fees for. <br />Fahey asked if the architect was trying to make an <br />alternate out of something that was not an alternate. <br />Kroos reported that the items he listed were not part <br />of the original workscope at the time the contract was <br />drawn up. <br />Blesener pointed out that the bids came in low enough <br />so that the lower parking lot as well as an irrigation <br />system at the Fire Station could be included. Blesener <br />felt there was a reasonable avenue where there should <br />be some additional reimbursement of the architect. <br />Fahey asked what the contract binds the City to. Fahey <br />pointed out that the City's concern was to get as much <br />as it could in the base contract. <br />Collova asked if the lower parking lot and retaining <br />wall were included in the base bid. <br />Kroos replied that they were not. Kroos also stated <br />that when the contract was drawn up the City did not <br />know if it would use a construction manager or a <br />general contractor. If it were a general contract <br />there would have been some alternate items included as <br />cost control items. <br />Scalze questioned paying the 7% fee on the sales tax <br />contingency. <br />Kroos reported that the original estimate that he gave <br />included everything that a general contractor would <br />include, both sales tax plus the overhead a general <br />contractor would charge, which in this case is the <br />Page 10 <br />
