MINUTES <br />CITY COUNCIL <br />OCTOBER 10, 1990 <br />replenishment clause. The Administrator felt that the <br />problem lies with a seemingly simple project that <br />becomes a complicated and thus requires additional <br />consultant review and reporting. He cautioned the <br />Council that we must be cognizant of this fact and <br />consider the cost implications when ordering additional <br />studies. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 90-10-458 - INSTRUCTING THE CITY <br />ATTORNEY AND CITY ADMINISTRATOR TO PUT TOGETHER AN <br />ORDINANCE AS WELL AS REVISE ANY CITY DOCUMENTS <br />NECESSARY TO ADDRESS COUNCIL'S CONCERN WITH DEVELOPER <br />COST REIMBURSEMENT <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Scalze, LaValle, Collova, Blesener, Fahey. <br />Nays (0). <br />Resolution declared adopted. <br />The Administrator reported that he will have some <br />recommendations for the Council's consideration at its <br />October 30th workshop meeting. <br />ARCHITECT'S The City Administrator reported that Boarman & <br />REQUE5T FOR Associates, the City's architect for the Fire Station <br />CONTRACT FEE and City Center projects, have requested a contract <br />ADJUSTMENT fee adjustment. The architect has indicated that the <br /> City has expanded the scope of both projects, <br /> therefore, they are entitled to a fee adjustment. The <br /> Administrator presented the Council with a handout <br /> which detailed the bids awarded for each project in <br /> relation to original budget projections. The <br /> Administrator also pointed out that the architect feels <br /> that he is entitled to a fee for costs associated with <br /> sales tax and the construction management fee. <br /> The Mayor pointed out that the contract was drawn as it <br /> was because the City wanted to maintain control over <br /> its costs. <br />The Administrator pointed out that the contract <br />provides that if there are workscope changes, the <br />architect would be reimbursed on a percentage of the <br />cost of those changes. <br />Fahey pointed out that the City had indicated that it <br />did not want a lot of bid alternates in order to keep <br />costs down. Fahey stated that he would view the <br />contract very tightly in favor of the City. <br />David Kroos, Boarman & Associates, reported that the <br />fees that were negotiated were very tiqht fees. 7% for <br />Page 9 <br />
