MINUTES <br />CITY COUNCIL <br />OCTOBER 10, 1990 <br />The Administrator pointed out that the City needs to be <br />careful about uniformity of assessments. The <br />Administrator suggested that it might be difficult to <br />pass the full cost of the improvement to the residents <br />who use the road for access. <br />Scalze suggested that these residents and Mr. <br />Brueggemann will have to share the cost of the <br />improvement. <br />The City Engineer stated that eventually Nadeau Road <br />will have to be improved and this improvement probably <br />should take place when Condit Street is improved. <br />Fahey suggested that the City Administrator negotiate <br />the issue with Mr. Brueggemann as part of the <br />Development Agreement. Fahey agreed that the project <br />should be deferred until such time as Condit is <br />improved. Fahey pointed out that the City is <br />precluding the use of the street by the developer, and <br />Nadeau Road is used primarily for access to the homes <br />to the west. Fahey felt that there must be a sharinq <br />of improvement costs. <br />Mark Malsam, Country Drive resident, suggested that <br />Ndeau Road be eliminated. <br />The Council pointed out that then the only access to <br />the homes to the west would be Condit, which would be <br />an extremely long cul-de-sac that exceeds Code <br />requirements. <br />Mr. Zender, Country Drive residents, stated that he <br />will be out-of-town on October 23rd, which is the date <br />of the assessment hearing for the Country Drive <br />improvement. Zender stated that it was his <br />understanding that the City intends to defer <br />approximately 500 of the assessment for the people <br />using the property for residential until that property <br />is sold. <br />The Administrator stated that the discussion was to <br />defer half of the assessment for a period of three <br />years. <br />Pelstring reported that he will direct Briggs & Morgan <br />to complete the Development Agreement documents. This <br />matter should return to the Counoil in about one month. <br />The Administrator pointed out that there will be some <br />assessment for the Country Drive improvement to the <br />Phase I project, and a waiver of appeal of assessment <br />document is being prepared for Mr. Brueggemann to sign. <br />Page 7 <br />
