Fahey reviewed the City Planner's report <br />dated October 9, 1990 wherein he has compared this <br />application with others that have requested creation of <br />lots without improved road access. Fahey noted the <br />Planner's statement that this application is for <br />creation of one additional lot on an existing private <br />road versus creation of a new private road. The <br />Planner also pointed out that there is no possibility <br />for a public street in this instance as there was in <br />the Stewart case. <br />Scalze asked the distinction between this application <br />and the proposal for development of the Clyde Hoffman <br />property north of Arcade Street. Scalze stated that <br />should the Council decide to allow this additional lot <br />on a private driveway, it better be prepared to allow <br />the same thing in similar situations. <br />Mr. Murphy appeared before the Council and reported <br />that the Ducharme family owned a farm in the area since <br />the 1830's. Over the years at various times, parts of <br />the original farm were subdivided off. Many years ago <br />before the City Codes were in effect, Mr. Ducharme was <br />allowed to divide property along his private driveway, <br />which resulted in three lots being serviced by this <br />driveway. Mr. Ducharme always assumed that he would be <br />able to divide the last lot off, and it would be a <br />hardship for Mr. Ducharme if he were not allowed to <br />divide this last lot. Mr. Murphy pointed out that the <br />private driveway serving three lots has existed for the <br />past 40 years. <br />Blesener asked the width of the driveway. <br />Mr. Ducharme replied that the driveway is 30 feet in <br />width. It is not possible to increase the width of the <br />driveway due to the grades in the area. <br />Scalze asked if there was an easement from Greenbrier <br />Circle to the Reid property that would be used someday <br />for access to additional lots on the Reid property. <br />Mr. Ducharme replied that the easement that he is aware <br />of in that area is a sewer easement. <br />Fahey felt the <br />was considered <br />was approved. <br />of the Hoffman <br />driveway that <br />issue is whether the private driveway <br />acceptable and conforming at the time it <br />Fahey pointed out that in the instance <br />property, the access was via a private <br />aas planned for the sole use of one home. <br />Page 14 <br />
