MINUTES <br />CITY COUNCIL <br />NOVEMBER 28, 1990 <br />before current Codes were in effect. <br />Fahey suggested that the house was placed as it was <br />with no intention of the property owner to divide the <br />property. <br />Tacheny reported that he eventually plans on tearing <br />down the existing house and building two new homes on <br />the property. <br />Blesener suggested that when the existing home is torn <br />down that would be the time to apply for a property <br />division. Blesener pointed out at that time the <br />property division could occur in such a manner as to <br />provide for a large setback for the home that would <br />front on LaBore Road, so that house would be in <br />conformance with existing setbacks on that street. <br />Katherine Garske stated that when the house was built <br />it was on the corner of Payne Avenue and LaBore Road. <br />Garske questioned why anyone would want to divide the <br />property and was concerned about the loss of large <br />trees on the property should another home be built. <br />Fahey agreed that the other issue was the setback of <br />existing homes along LaBore Road, and suggested that <br />any division of the property in the future would be <br />contingent upon the new house conforming to existing <br />setbacks in the area. <br />There was no one else from the general public present <br />wishing to comment. <br />Upon motion by Blesener, seconded by Fahey, the public <br />hearing was closed. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION N0. 90-11-525 - DENYING THE TACHENY REQUEST <br />FOR SUBDIVISION OF PROPERTY LOCATED AT 623 LABORE ROAD <br />AND VARIANCE REQUEST FOR NON-CONFORMING REAR YARD <br />SETBACK BASED ON THE RECOMMENDATION OF THE CITY PLANNER <br />AND PLANNING COMMISSION FOR DENIAL <br />The foregoing resolution was duly seconded by Collova. <br />Ayes (4) Fahey, Collova, LaValle, Blesener. <br />Nays (0). <br />Resolution declared adopted. <br />BRAUSEN Fahey opened the public hearing to consider the request <br />LOT SPLIT & of Ted Brausen for lot split and conditional use permit <br />CUP for shared parking at 2822 Rice Street.
