MINUTES <br />CITY COUNCIL <br />DECEMBER 26, 1990 <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 90-12-560 - APPROVING THE DEVELOPMENT <br />STAGE AND FINAL STAGE PUD AS WELL AS PRELIMINARY PLAT <br />OF THE PROPERTY AT 177 EAST COUNTY ROAD B AS REQUESTED <br />BY THE BACHMEIER CORPORATION SUBJECT TO THE <br />RECOMMENDATIONS OF THE CITY PLANNER AS CONTAINED IN HIS <br />MEMO DATED DECEMBER 10, 1990, THE RECOMMENDATIONS OF <br />THE PLANNING CONIMISSION THAT EXPOSED FACADES BE <br />SURFACED IN BRICK, THAT THE CITY PLANNER BE INVOLVED IN <br />THE ENFORCEMENT OF THE LANDSCAPE ORDINANCE, THAT THE <br />PARK CHARGE BE IN THE FORM OF CASH RATHER THAN LAND AND <br />BE PHASED IN AS DEVELOPMENTS ARE APPROVED AND SUBJECT <br />TO THE DEVELOPER ENTERING INTO A DEVELOPMENT AGREEMENT <br />WITH THE CITY <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Blesener, LaValle, Fahey, Scalze. <br />Nays (0). <br />Resolution declared adopted. <br />ALLEYWAY Fahey reported that Hoc Bao Lam has withdrawn his <br />VACATION request for vacation of the alleyway easement adjacent <br />to this property. Fahey pointed out that the applicant <br />had failed to submit an adequate petition supporting <br />the vacation. The Council cannot act on a vacation <br />unless a valid petition is submitted. The Planning <br />Commission had recommended approval of the vacation. <br />Gene Fasciana asked the status of Hoc Bao Lam's fence <br />which is on the easement area. <br />Fahey replied that the fence will be moved in the <br />spring. <br />Pat Vitale reported that the Planning Commission <br />indicated that the City is trying to vacate all <br />alleyways in the City. Vitale pointed out that it was <br />in his favor if the alleyway was vacated, since he <br />would gain additional property. The Planning <br />Commission supported the vacation. Vitale also <br />outlined the situation with the fence which Mr. Lam <br />constructed on the alleyway area. <br />Fahey asked if a variance could be granted to allow the <br />fence to remain. <br />The City Planner replied that a property owner cannot <br />construct a fence on public right-of-way and the fence <br />will have to be moved.
