MINUTES <br />CITY COUNCIL <br />DECEMBER 26, 1990 <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (4) Scalze, Blesener, LaValle, Fahey. <br />Nays (0). <br />Resolution declared adopted. <br />SITE PLAN Mr. Jerry Kukk appeared before the Council requesting <br />REVIEW - site plan review for construction of an auto body shop <br />KUKK at 83 and 89 West County Road C. Kukk reported that he <br />is proposing to construct a block building that will <br />have a stucco facade with a half-brick front. Kukk <br />reported that he is willing to work with the City on <br />his request. <br />Fahey pointed out that the Planning Commission's <br />discussion of this proposal. <br />Scalze noted that the real issue is a change in the <br />City's ordinance allowing auto body repair in <br />commercial areas. If this were approved, the City <br />would be faced with similar requests in other <br />commercial areas of the City. Scalze noted that the <br />business has been in existence for the past 27 years, <br />but noted that when it was first approved, the City did <br />not anticipate the development of homes in the area. <br />Scalze also pointed out that the City required Frank <br />Frattalone to relocate his business because it was <br />located in the wrong zoning, and to be fair, Scalze did <br />not see how Mr. Kukk's request could be approved. <br />Kukk pointed out that the new residents in the area <br />will not be happy with his existing operation, and this <br />is why he is proposing the new building which would <br />include a paint booth. <br />Blesener asked if State Law required paint booths, <br />notinq that Mr. Kukk may not be able to paint without a <br />booth. <br />The City Planner was unsure what State Law required, <br />but indicated that he would check on it. <br />Kukk pointed out that the business is a family one and <br />since there are no employees, OSHA does not regulate <br />the business. <br />Fahey stated that auto body repair shops belong in the <br />industrial district, and felt the City should work with <br />Mr. Kukk to get the business moved. Fahey stated that <br />he was not in favor of expanding the use in its current <br />location. Fahey pointed out that other businesses in <br />the industrial park raise concerns about businesses <br />Page 9 <br />
