MINUTES <br />CITY COUNCIL <br />JANUARY 23, 1991 <br />Scalze stated that there was some discussion about <br />tying the improvement of Costa Lane in with the <br />upgrading of Vanderbie. <br />DeBace pointed out that if someone wanted to buy the <br />entire parcel from the Costa Family, it may be possible <br />that the project would be developed at one time. <br />Otherwise, the Costa Family intends to phase in the <br />project. <br />Hanson pointed out that there is no watermain on <br />Vanderbie, Al1en Avenue, or Edgerton Street. There is <br />also undeveloped land north of Allen Avenue. Hanson <br />suggested that it may be cost-effective to look at the <br />entire area at one time. <br />Peyer pointed out that it would be in his best <br />interests to get the best price possible for upgrading <br />Vanderbie. <br />Blesener pointed out that if the large majority of <br />property owners in a given area are opposed to <br />watermain improvement, for example, City policy has <br />been not to order the improvement. <br />Clarence Bruhn, resident on Vanderbie, asked how Costa <br />Lane would effect his property. <br />Blesener pointed out that the road would not touch the <br />Bruhn property. <br />There was no one else from the general public present <br />wishing to comment on this matter. <br />Upon motion by Blesener, seconded by LaValle, the <br />public hearing was closed. <br />LaValle reported that while he supported the <br />preliminary plat as presented, he did not support <br />requiring a walkway easement as part of the plat. <br />Collova stated that he, too, opposed the walkway <br />easement. <br />Scalze pointed out that the walkway easement would only <br />run from Vanderbie to Costa Lane and not all the way <br />through to DeSoto. Scalze viewed this as a suitable <br />compromise. <br />DeBace reported that he has been investigating these <br />walkway easements and reported that several insurance <br />companies have informed him that the owner of the <br />property over which the easement runs would assume some <br />liability for the walkway and that homeowners insurance <br />policy would not cover this liability. DeBace reported <br />that the Costa Family is opposed to giving the walkway <br />easement. <br />Page 5 <br />
