MINUTES <br />CITY COUNCIL <br />JANUARY 23, 1991 <br />Scalze pointed out that the people adjacent to the <br />pathways in the Aspen Way area really like them. <br />Scalze felt that by not requiring the pathways in this <br />instance, the City is treating developers differently. <br />Blesener reported that he would like to see the <br />requirement of a walkway as part of the preliminary <br />plat, however, since it does not appear a walkway has <br />the support of the majority of the Council, he would <br />not include it in a motion. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION 91-1-26 - APPROVING THE COSTA ESTATES <br />PRELIMINARY PLAT AS PRESENTED ON PAGE 18 OF THE COUNCIL <br />AGENDA SUBJECT TO THE CONDITION THAT APPEARANCE OF THE <br />PROPER SETBACK BE MAINTAINED FOR THE FIRST HOUSE TO THE <br />NORTH ON DESOTO AVENUE, THAT SETBACK BEING 40 FEET FROM <br />CURBLINE TO THE HOUSE, AS WELL AS SUBJECT TO THE <br />RECOMMENDATIONS OF TAE CITY PLANNER AS CONTAINED IN HIS <br />REPORT DATED JANUARY 7~ 1991 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Blesener, LaValle, Hanson, Scalze, Collova. <br />Nays (0). <br />Resolution declared adopted. <br />ADULT USE Mayor Hanson opened the public hearing to consider <br />ORDINANCE amending Chapter 900 of the Municipal Code relating to <br />the definition of adult uses; accessory within the B-1, <br />Limited Neighborhood Business District; to regulate <br />adult uses principal and accessory to the B-2, <br />Auto-Oriented Business District. <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Upon motion by Blesener, seconded by Scalze, the public <br />hearing was closed. <br />The City Attorney reviewed the proposed Adult Use <br />Ordinances, pointing out one typographical error. <br />The City Planner reported that in reviewing the <br />Ordinance, the Planning Commission suggested that <br />churches be included in the listing of types of uses <br />from which minimum distances must be met. The Planner <br />reported that his research shows that including <br />churches might raise the issue of violation of <br />constitutional rights and suggested that the Ordinance <br />restrict distances from the Public Zoning District <br />instead. <br />Page 7 <br />
