MINUTES <br />CITY COUNCIL <br />March 13, 1991 <br />The Administrator reported that he will contact other <br />cities to determine what they are requiring as far as <br />Dram Shop for temporary organizations. The <br />Administrator stated that he will also determine if the <br />City can obtain Dram Shop on behalf of these other <br />organizations. <br />Steve Morelan asked why the State exempted <br />organizations from obtaining Dram Shop if their sales <br />are under $10,000. <br />The City Attorney reported that the explanation that he <br />has heard is because of the expense of Dram Shop for <br />organizations with temporary licenses and limited <br />sales. <br />The City Administrator felt the State addressed the <br />situation from a hardship issue for the licensee and <br />not a risk management issue for municipalities. <br />Blesener pointed out that on page 23 the number of <br />on-sale intoxicating liquor licenses should be four. <br />Blesener then questioned the number of licenses <br />referred to on page 30. <br />The City Attorney reported that State law allows the <br />City six on-sale liquor licenses plus the City has two <br />additional by special legislation. Rather than attempt <br />to return the two licenses granted by special <br />legislation, the Ordinance restricts the number given <br />by Statute to four. <br />Blesener asked the business owners' feelings about the <br />proposed ordinance. <br />LaValle replied that he has given the business owners' <br />copies of the latest draft of the ordinance, and since <br />their concerns were addressed, they are comfortable <br />with the ordinance as proposed. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 91-3-92 - TABLING ACTION ON THE PROPOSED <br />LIQUOR ORDINANCE UNTIL THE NEXT COUNCIL MEETING PENDING <br />ADDITIONAL INFORMATION FROM THE CITY ATTORNEY AND CITY <br />ADMINISTRATOR ON THE ISSUE OF LIQUOR LIABILITY <br />INSURANCE <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Blesener, LaValle, Scalze, Hanson, Collova. <br />Nays (0). <br />Resolution declared adopted. <br />Page 7 <br />
