MINUTES <br />CITY COUNCIL <br />March 13, 1991 <br />PAWN SHOP The City Attorney submitted to the Council a proposed <br />ORDINANCE pawn shop ordinance. The City Attorney reviewed the <br />fees that the City of Brooklyn Park charges for the <br />licensing of pawn shops. <br />LaValle suggested that action on this ordinance be <br />tabled until the next meeting so that the Council has <br />an opportunity to review the ordinance. <br />The City Attorney reported that two major points in the <br />ordinance involve requiring a 4 month redemption period <br />for pawned merchandise and prohibiting pawn shops from <br />accepting weapons. <br />Blesener asked if the ordinance provides a time period <br />for existing pawn shops to comply with the ordinance. <br />The City Attorney stated that the ordinance can be <br />amended to include this provision. The ordinance <br />should also include a time period for existing pawn <br />shops to obtain a license. <br />Council discussed what would be reasonable time periods <br />for licensing and conformance, and requested the City <br />Attorney redraft the ordinance and include time periods <br />he believes to be reasonable. <br />The Administrator asked if imposing these standards on <br />an existing business created a hardship for that <br />business, does the City incur any exposure or <br />liability? The City Attorney stated that the City does <br />not incur any liability in this instance. <br />Collova suggested that the City adopt fees similar to <br />Brooklyn Park's, however, increasing them by $50. <br />Collova pointed out that Brooklyn Park's fees may have <br />been in existence for a few years, and Little Canada <br />didn't want its fees to be on the low end of the scale. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 91-3-93 - TABLING ACTION ON THE PROPOSED <br />PAWN SHOP ORDINANCE PENDING FURTHER INFORMATION FROM <br />THE CITY ATTORNEY <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) LaValle, Blesener, Scalze, Collova, Hanson. <br />Nays (o). Resolution declared adopted. <br />Tracy George expressed concern that an existing <br />business may not be able to comply with the proposed <br />ordinance and, therefore, be forced out-of-business. <br />Page 8 <br />
