MINUTES <br />CITY COUNCIL <br />APRIL 10, 1991 <br />Blesener pointed out that Mr. Malsam does not have the <br />90 to 120 days to wait for a decision. <br />Hanson pointed out that the developer has indicated <br />that he has occupancy dates of July lst on the Phase II <br />building and September lst on Phase III. <br />Malsam asked if the City was bound with LEB Development <br />as the developer of the area. <br />The City Administrator reported that if the buy-out <br />occurred, there would be a development agreement with <br />LEB Development giving that firm first right-of-refusal <br />for Phase IV. <br />Upon motion by Blesener, seconded by Hanson, the public <br />hearinq was closed. <br />Blesener felt the City had no choice at this time but <br />to approve the Malsam request. <br />Scalze asked if the Council was willing to require that <br />the building appearance be changed to fit in with the <br />Kandice Heights development. <br />Blesener replied that his intent is the property would <br />have to meet the requirements of the PUD District. <br />Blesener stated that he did not believe much could be <br />done to the front of the house to change the appearance <br />to conform with the Kandice Heights development. <br />Blesener felt, however, that other requirements such as <br />parking, curbing, etc, must conform with City standards <br />for that district. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 91-4-131 - APPROVING THE MALSAM REQUEST <br />FOR A PLANNED UNIT DEVELOPMENT TO ALLOW THE CONVERSION <br />OF EXISTING RESIDENTIAL STRUCTURE TO OFFICE USE AND <br />CONVERSION OF EXISTING GARAGE TO A SIGN SHOP, AS WELL <br />AS CONSTRUCTION OF ANOTHER BUILDING TO SUPPORT THAT <br />ACTIVITY FOR THE PROPERTY LOCATED AT 2825 COUNTRY DRIVE <br />SUBJECT TO THE RECOMMENDATIONS OF THE CITY PLANNER AS <br />CONTAINED IN HIS REPORT DATED MARCH 11, 1991 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Blesener, LaValle, Collova, Hanson. <br />Nays (1) Scalze. <br />Resolution declared adopted. <br />Zender asked if Council action eliminated the <br />possibility of a buy-out on a contract-for-deed basis. <br />Page 13 <br />
