MINUTES <br />CITY COUNCIL <br />APRIL 10, 1991 <br />Collova replied that should the sale of the Malsam <br />property not go through, the Council would be willing <br />to discuss the matter again. <br />COSTA The City Administrator reported that the Costa Estates <br />ESTATES Development Agreement has been signed by the property <br />DEVELOPMENT owners. The Administrator pointed out the map included <br />AGREEMENT in the additions to the agenda which shows how the <br /> phasing of Costa Estates will occur. The Administrator <br /> noted that the lots along DeSoto Street will be the <br /> first ones developed once the street improvement is <br /> completed, and either the lots along Costa Lane or <br /> Vanderbie would be developed in the next phase. <br /> Mr. DeBace reported that the Costa Family is in <br /> agreement with the terms and conditions outlined in the <br /> development agreement, and noted that the Costa Family <br /> also signed the waiver of right to appeal assessments <br /> for DeSoto Street. <br />The City Administrator pointed out that the waiver was <br />only an exhibit included in the Development Agreement, <br />and it was not necessary to have this waiver signed at <br />this time. <br />DeBace replied that the Costa Family is in agreement <br />with the waiver and it the City executes the waiver, <br />that was fine. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 91-4-132 - APPROVING THE COSTA ESTATES <br />DEVELOPMENT AGREEMENT AND AUTHORIZING THE MAYOR AND <br />CITY ADMINISTRATOR TO EXECUTE THE AGREEMENT ON BEHALF <br />OF THE CITY <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Blesener, LaValle, Collova, Hanson, Scalze. <br />Nays (0). <br />Resolution declared adopted. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 91-4-133 - CALLING FOR A PUBLIC xEARING <br />ON WEDNESDAY, MAY 1, 1991, AT 7:30 P.M.
