MINUTES CITY COUNCIL APRIL 10, 1991 Collova replied that should the sale of the Malsam property not go through, the Council would be willing to discuss the matter again. COSTA The City Administrator reported that the Costa Estates ESTATES Development Agreement has been signed by the property DEVELOPMENT owners. The Administrator pointed out the map included AGREEMENT in the additions to the agenda which shows how the phasing of Costa Estates will occur. The Administrator noted that the lots along DeSoto Street will be the first ones developed once the street improvement is completed, and either the lots along Costa Lane or Vanderbie would be developed in the next phase. Mr. DeBace reported that the Costa Family is in agreement with the terms and conditions outlined in the development agreement, and noted that the Costa Family also signed the waiver of right to appeal assessments for DeSoto Street. The City Administrator pointed out that the waiver was only an exhibit included in the Development Agreement, and it was not necessary to have this waiver signed at this time. DeBace replied that the Costa Family is in agreement with the waiver and it the City executes the waiver, that was fine. Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION N0. 91-4-132 - APPROVING THE COSTA ESTATES DEVELOPMENT AGREEMENT AND AUTHORIZING THE MAYOR AND CITY ADMINISTRATOR TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY The foregoing resolution was duly seconded by LaValle. Ayes (5) Blesener, LaValle, Collova, Hanson, Scalze. Nays (0). Resolution declared adopted. Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION N0. 91-4-133 - CALLING FOR A PUBLIC xEARING ON WEDNESDAY, MAY 1, 1991, AT 7:30 P.M. TO CONSIDER THE IMPROVEMENT OF DESOTO STREET BY WATERMAIN, SANITARY SEWER, STORM DRAINAGE, CURB AND GUTTER, AND STREET Page 14
