MINUTES <br />CITY COUNCIL <br />APRIL 24, 1991 <br />Administrator asked if the use of this land was <br />restricted to park. <br />The City Attorney replied that if the land was <br />dedicated to the City as park land, then its use is <br />restricted to park usage. <br />Scalze pointed out that the land has not been developed <br />as park because the adjacent residential area has not <br />been developed. However, the City required the <br />dedication because it identified the future need for <br />park land in this area. Scalze pointed out that <br />development of this piece of park land would tie into <br />development of the Water Works trail. Scalze suggested <br />that the Park Commission research the future <br />development of this piece of property as park land. <br />Scalze commented that if this piece of property was not <br />designated as park land on the final plat, it should be <br />clear from the past Council minutes that it was the <br />intention of the City that this be park land. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 91-4-144 - CONTINUING THE PUBLIC HEARING <br />ON THE YORKTON RIDGE WEST PRELIMINARY PLAT UNTIL THE <br />MAY 22, 1991 COUNCIL MEETING <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Blesener, LaValle, Hanson, Scalze, Collova. <br />Nays (O). <br />Resolution declared adopted. <br />PUD & CUP Mr. Tim Malloy, representing U.S. West, appeared before <br />CELLULAR the Council requesting approval of an amendment to <br />TOWER Planned Unit Development and Conditional Use Permit to <br />U.S. WEST allow the construction of a 125 foot cellular telephone <br /> tower and equipment building at 5 East County Road B. <br /> Malloy described the proposed location of the tower and <br /> equipment building. Malloy also presented a landscape <br /> plan for the site in response to the recommendations of <br /> the City Planner and Planninq Commission. <br /> Malloy described the appearance of the tower in detail <br /> as well as reported that only limited grading of the <br /> site will be necessary for construction of the <br /> equipment building. <br /> Scalze reported that she had a problem with the tower <br /> proposal. Scalze pointed out that the PUD on the <br /> property is for multiple buildings, and only one <br /> Page 6 <br />
