MINUTES <br />CITY COUNCIL <br />AUGUST 14, 1991 <br />RESOLUTION NO. 91-8-266 - APPROVING THE MODIFICATION OF <br />THE TAX INCREMENT FINANCING PLAN FOR THUNDER BAY TAX <br />INCREMENT FINANCING DISTRICT NO. 1, WITHIN THUNDER BAY <br />DEVELOPMENT DISTRICT, AS ENLARGED <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Blesener, LaValle, Scalze, Hanson, Collova. <br />Nays (0). Resolution declared adopted. <br />VACATION Hanson opened the public hearing to consider the <br />PORTION OF vacation of a portion of the Country Drive road <br />COUNTRY DR. right-of-way. <br />The City Administrator reported that this vacation has <br />been requested by the developer of the Kandice Heights <br />II project to correct an oversight in similar vacation <br />proceedings held last fall. At that time 4 1/2 feet of <br />road right-of-way for Nadeau Road was vacated. <br />However, there is an area where Country Drive road <br />right-of-way overlapped, and this is the right-of-way <br />now being requested to be vacated. The Administrator <br />requested that any action to vacate the right-of-way be <br />subject to retention of necessary utility easements as <br />well as execution and performance under the Kandice <br />Heights Phase II Development Agreement. This vacation, <br />as well as the one approved last fall, would not become <br />effective until the developer performs under the <br />Development Agreement. <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Upon motion by Scalze, seconded by Blesener, the public <br />hearing was closed. <br />LaValle reported that he received a phone call from a <br />Burke Lane resident who wants to make sure that LEB <br />Development continues to work on their problems at the <br />Kandice Heights Phase I building. <br />The City Administrator reported that the City is <br />monitoring the situation at Kandice Heights I, and has <br />been in contact with Sue Nelson, who is representing <br />the Burke Lane neiqhborhood, on the matter. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 91-8-267 - APPROVING THE VACATION OF A <br />PORTION OF COUNTRY DRIVE ROAD RIGHT-OF-WAY AS DESCRIBED <br />IN CORRESPONDENCE ON PAGE 16 OF THE AGENDA SUBJECT TO <br />RETENTION OF NECESSARY UTILITY EASEMENTS BY THE CITY <br />AND SUBJECT TO EXECUTION AND PERFORMANCE UNDER THE <br />KANDICE HEIGHTS PHASE II DEVELOPMENT AGREEMENT <br />Page 3 <br />
