MINUTES <br />CITY COUNCIL <br />AUGUST 14, 1991 <br />The foregoing resolution was duly seconded by Collova. <br />Ayes (5) Scalze, Collova, Hanson, Blesener, LaValle. <br />Nays (0). Resolution declared adopted. <br />VACATION oF The Mayor opened the public hearing to consider the <br />PORTION OF vacation of a portion of the Condit Street road right- <br />CONDIT STR. of-way. <br />RON CARLSON <br />Mr. Ron Carlson appeared before the Council reporting <br />that he has petitioned for the vacation of the Condit <br />Street road right-of-way adjacent to his property on <br />Burke Lane. Carlson reported that he presented his <br />proposal to the Park Commission which has recommended <br />vacation of the west 15 feet of the right-of-way and <br />retention of the east 15 feet by the City for future <br />walkway access to the Water Works property. Carlson <br />reported that his reason for requesting the vacation is <br />so he can set the house he plans to build on his <br />property closer to the street. Carlson explained that <br />his lot is pie-shaped and has about 60 feet of frontage <br />at the street. The City previously granted him a <br />variance for a 10 foot sideyard setback on his property <br />line abutting the Condit right-of-way. But even with <br />this variance he would have to set his house back about <br />125 feet from the street. The additional 15 feet from <br />Condit Street would allow him to move the house up 30 <br />or 40 feet closer to the street. <br />Blesener asked about the location of the Gagne <br />driveway. <br />The City Administrator reported that it appears that <br />the Gaqne driveway encroaches on the Condit Street <br />right-of-way. However, without a survey it is <br />difficult to determine the exact amount of <br />encroachment. The Administrator recommended that the <br />vacation be subject to Mr. Gagne relocating his <br />driveway so that he is not utilizing public <br />right-of-way. <br />Carlson believed that a portion of the Gagne driveway <br />was on the right-of-way, and pointed out that Mr. Gagne <br />did siqn the petition in support of the vacation. <br />Scalze asked if the Carlson property was considered a <br />corner lot. <br />Carlson replied that his property was considered a <br />corner lot, therefore, the setback on his lot line <br />adjacent to Condit right-of-way was to have been 30 <br />feet.
