MINUTES <br />CITY COUNCIL <br />OCTOBER 2, 1991 <br />4. Has been in existence as a non-profit corporation <br />or as a 501(c) tax exempt organization at least <br />three (3) consecutive years prior to the date it <br />begins its gambling operations. <br />5. Complies with all of the provisions of this <br />ordinance. <br />*A premises permit issued by the City under this <br />ordinance may be suspended by the City for violation <br />of ordinance or revoked for failure to meet the <br />qualifications set out in Section 119.020 (see <br />Roseville Ordinance), or a willful violation of any <br />part of Section 119 of the City's ordinance, or a <br />failure to comply, for any reason with any provision, <br />guarantee, or claim made in an applicant's original <br />license application to either the City of the State of <br />Minnesota. <br />*No license or permit issued by the City, including any <br />Bingo Hall License, grants the licensee a property <br />right or entitlement to the license or permit. The <br />City may refuse to issue, renew or revoke the license <br />or permit for any reason and will not incur liability <br />for any damages including, but not limited to, direct, <br />consequential or incidential damages, deprivation of <br />property, loss of income, loss of profits or loss of <br />livelihood. <br />*Submit complete listing, as part of the application <br />package, and quarterly thereafter, of all employees, <br />members, principal officers and consultants, including <br />addresses, driver's license numbers, date of birth, <br />position held, and salary including benefits and <br />perks. <br />*Shall expend at least 50% or more of its net proceeds <br />from charitable gambling at Little Canada locations to <br />or for purposes which benefit programs or activities <br />occurring in the Little Canada trade area, in which a <br />majority of those directly benefitted by such programs <br />or activities are Little Canada residents who <br />participate in such programs or activities. The <br />Little Canada trade area is defined as the City of <br />Little Canada and each city contiquous to Little <br />Canada. (City Attorney to comment on legality of this <br />wording which is used by the City of St. Paul.) <br />*In Minnesota Statutes 349.213, Subdivision (c), what <br />are the implications of the wording "applies equally <br />to all forms..." to other licensees relative to this <br />ordinance. <br />Page 3 <br />
