MINUTES <br />CITY COUNCIL <br />OCTOBER 23, 1991 <br />The Fire Chief reported that the Fire Department will <br />handle the sale of the old pumper truck. <br />CHARITABLE LaValle reported that the Charitable Gambling Control <br />GAMBLING Board will be conducting a continuing education class <br />ORDINANCE on local control rights and responsibilities on October <br />30th, 7 P.M., at St. Paul Technical College. LaValle <br />stated that he would provide the Council with <br />information on this class. <br />The City Attorney reviewed his letter as well as <br />proposed charitable gambling ordinance as contained in <br />the Council agendas. The Attorney noted that there are <br />three references to background information in the <br />ordinance that need to be clarified to include State <br />Law provisions which limit the City's authority to go <br />back more than five years. <br />Scalze asked about the City's ability to prevent a <br />convicted felon or spouse from attending meetings of a <br />charitable gambling organization. <br />The City Attorney did not feel that the City had the <br />authority to prevent someone from attending a meeting <br />of a charitable gambling organization. The City can <br />prevent a convicted felon from serving as an officer or <br />employee of such an organization, however. The City <br />Attorney pointed out that the City's ultimate authority <br />rests with consideration of a premise permit. <br />Blesener pointed out the Attorney's comments that the <br />City cannot require a one-year premise permit rather <br />than the two-year permit provided for under State Law. <br />The City Attorney pointed out that State Law provides <br />for a two-year premise permit. The City would already <br />have the authority to review a premise permit for <br />violations, and if violations exist, the City could <br />take revocation action. <br />Scalze pointed out that the current licenses are <br />one-year, and will come up for renewal in May, June, <br />July and August of 1992. <br />The City Attorney agreed, and pointed out that State <br />Law has been chanqed, and at renewal time, the City <br />will be acting on two-year premise permits. <br />The City Attorney suggested that Section 815.020 (C) be <br />amended to require at least three affirmative votes for <br />the approval of a premise permit application. <br />Page 8 <br />
