MINUTES <br />CITY COUNCIL <br />FEBRUARY 26, 1992 <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (4) Scalze, Blesener, Collova, LaValle. <br />Nays (0). <br />Resolution declared adopted. <br />GAMBLING LaValle explained the proposal to amend the City's <br />ORDINANCE Gambling Ordinance with regard to backqround checks on <br />officers, members, consultants and employees for <br />charitable organizations operatinq gambling within the <br />City. LaValle reported that the existing ordinance <br />prohibits these individuals from having felony or gross <br />misdemeanor convictions within the past five years. <br />The feeling is that this is too restrictive, and that <br />felony or gross misdemeanor convictions should be <br />related to theft or drug-related crimes. <br />The City Attorney reviewed his letter of February 21, <br />1992 and pointed out that State Law prohibits officers <br />or members of the governing body of a lawful gamblinq <br />organization from having a felony or gross misdemeanor <br />conviction of any kind during the last five years. The <br />City's ordinance mirrors that State Law. However, the <br />proposal before the Council prohibits any member, <br />consultant or employee from having a felony or gross <br />misdemeanor conviction within the last five years for a <br />theft or drug-related crime. <br />Mary Ann O'Kane felt that consultant should be included <br />in this ordinance requirement. <br />It was explained that State Law is mirrored as far as <br />officers or members of the governing body of a lawful <br />gambling organization. These individuals cannot have a <br />felony or gross misdemeanor conviction of any kind <br />within the last five years. With regard to members, <br />consultants or employees, City Ordinance, as proposed, <br />would prohibit these individuals from having a felony <br />or qross misdemeanor conviction for theft or <br />drug-related crime within the last five years. <br />In reviewing the proposed ordinance revision, Council <br />noted that "member" had been omitted from some of the <br />ordinance sections. Council instructed the City <br />Attorney to correct that omission. <br />Mr. Blesener introduced the following ordinance and <br />moved its adoption: <br />ORDINANCE NO. 356 - AMENDING CHAPTERS 815 OF THE CITY <br />CODE OF THE CITY OF LITTLE CANADA REGULATING LAWFUL <br />GAMBLING TO MODIFY PROHIBITIONS AND REQUIREMENTS <br />RELATING TO PAST CRIMES OR MISCONDUCT OF DIRECTORS, <br />MEMBERS OR CONSULTANTS <br />Page 18 <br />
