MINUTES <br />CITY COUNCIL <br />JUNE 16, 1992 <br />up by the City either through MSA funding or general <br />taxation. It was noted that in street reconstruction <br />80% of project costs are typically assessed and the <br />remaining 20% paid for through general taxation. <br />Ms. Torala asked why her estimated assessment for the <br />LaBore Road improvement is $14,000. Torala indicated <br />that she was already assessed $10,000 for the DeSoto <br />Street improvement. <br />The City Engineer replied that the Torala property was <br />assessed 20% of its footage on the side yard for Lot 18 <br />for DeSoto Street. Lot 18 would be assessed on the <br />front yard for the LaBore Road improvement. The <br />Engineer also pointed out that the front footage <br />assessment for the DeSoto Street improvement was $73 to <br />$74 per front foot. <br />The City Administrator estimated that Lot 18 owned by <br />Ms. Torala, was assessed less than $2,500 for the <br />DeSoto Street assessment. The City Administrator <br />pointed out that this particular situation is a <br />difficult one since Ms. Torala owns a very large piece <br />of property, approximately 270 feet by 160 feet. The <br />City is trying to minimize the assessment for the <br />LaBore Road improvement, however, it is an issue of <br />equity. The Torala property could be subdivided and, <br />therefore, the property owner should pay the cost for <br />benefit to future lots. <br />Mrs. Herford reported that she purchased her property <br />because of the large lot, and felt she was now being <br />punished for it. <br />A property owner along LaBore Road indicated that their <br />property was assessed in 1978, and they are still <br />paying this assessment. This property owner indicated <br />that she did not want LaBore Road ripped up and <br />widened. This property owner stated that she did not <br />need the improvement made in order to accommodate the <br />heavy traffic. <br />The Mayor pointed out that the City needs to have roads <br />that are driveable. The Mayor noted the recent <br />development in the area and acknowledged that this <br />development has caused additional wear and tear on <br />LaBore Road, as well as has the bus traffic on the <br />road. The Mayor indicated that the road is in rough <br />shape and something must be done with it. The Mayor <br />also pointed out that this portion of road is an <br />important connecting link in the City's road system. <br />Page 7 <br />
