MINUTES <br />CITY COUNCIL <br />JULY 8, 1992 <br />cancel the use of the area by the City upon 60 days <br />written notice. Blesener felt that there should be <br />some protection to the City. <br />The City Administrator stated that the provision is a <br />protection for the Water Department should they receive <br />complaints about the trail usage. The Administrator <br />did not feel it would be inappropriate for the City to <br />attempt to negotiate a modification of this provision. <br />Quirin suggested that the City request a hearing <br />examiner be involved in any action by the Water <br />Department to cease the City's use of the area. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 92-7-222 - APPROVING THE AGREEMENT WITH <br />THE ST. PAUL WATER DEPARTMENT FOR THE CITY'S USE OF <br />WATER WORKS PROPERTY LYING BETWEEN COUNTRY DRIVE AND <br />SOUTH OWASSO BLVD. FOR TRAIL PURPOSES BASED ON THE <br />PUBLIC HEARINGS WHICH HAVE BEEN HELD ON THIS <br />IMPROVEMENT, BASED ON THE PETITION RECEIVED BY THE CITY <br />IN SUPPORT OF THE IMPROVEMENT, BASED ON THE <br />RECOMMENDATION OF THE PARK COMMISSION, AND SUBJECT TO <br />THE TRAIL BEING CONSTRUCTED AS WAS DESCRIBED BY THE <br />PARK CONSULTANT THIS EVENING, CONDITIONED UPON THE CITY <br />ATTORNEY AND CITY ADMINISTRATOR CONTACTING THE ST. PAUL <br />WATER DEPARTMENT REGARDING AN AMENDMENT TO PROVISION #9 <br />AS CONTAINED IN THE AGREEMENT WAICH WOULD GIVE THE CITY <br />AN APPEAL PROCESS TO ANY ACTION BY THE WATER DEPARTMENT <br />TO CEASE THE CITY'S USE OF THIS AREA, AND AUTHORIZING <br />THE MAYOR AND CITY ADMINISTRATOR TO EXECUTE AN AMENDED <br />AGREEMENT AS DESCRIBED ABOVE ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) Scalze, Blesener, Collova, Hanson, LaValle. <br />Nays (0). Resolution declared adopted. <br />NADEAU Bill Sanders presented plans for improvement of a play <br />WILDLIFE structure in Nadeau Wildlife Park. Sanders reported <br />PLAY that the improvement has been requested by the <br />STRUCTURE neighbors in the area. If the Council authorizes the <br />advertisement for bids, it is anticipated that the <br />project could be begun this fall. Estimated cost is <br />$50,000, and the funding for this project has been <br />donated by Little Canada Charity Plus, Inc. <br />Mr. Collova introduced the following resolution and <br />moved its adoption: <br />Page 8 <br />
