MINUTES <br />CITY COUNCIL <br />NOVEMBER 18, 1992 <br />remodeling would be required, this is not a practical <br />option. This leaves a fourth option, that being <br />acquisition of the property by the City. Crawford <br />reported that he does not know the full financial <br />picture of the TIF District and understands that <br />development in the area has stalled, but Mr. Malsam is <br />asking for help. Crawford pointed out that Malsam is <br />in this position not because of anything that he has <br />done. The hope is that the City will determine a way <br />through the TIF District or another means to enter into <br />discussions about the acquisition of the property, or <br />arrange for the acquisition of the property by someone <br />else, so that Malsam can be made economically whole. <br />Crawford asked that the Council authorize the <br />appropriate people to sit down and attempt to come up <br />with a solution. <br />Scalze pointed out that when Mr. Malsam purchased the <br />property it was already zoned commercial. Scalze asked <br />if Crawford was saying that Malsam purchased commercial <br />property, is using it as residential, but could not <br />sell it to anyone for a similar use. <br />Crawford indicated that banks have indicated that they <br />would not finance a non-conforming use. Crawford <br />pointed out that the property is now a part of a PUD <br />which is different than a straight commercial use. <br />Hanson pointed out that Malsam has two neighbors in the <br />same situation, as well as the owner of an empty lot in <br />the area. <br />Crawford replied that he is aware of the implications <br />of that. <br />Scalze agreed that the City changed the zoning of the <br />area to PUD, but that change was made at the request of <br />the property owners in order to make the property more <br />saleable. <br />Crawford replied that Malsam went along with the PUD <br />zoning since it appeared it was the most appropriate <br />thing to do. <br />Hanson stated that he did not want to see the City go <br />into the real estate business, and did not believe this <br />was fair to the tax payers of the City. Once the City <br />acquired the property it would go off the tax rolls <br />unless there was a buyer in hand to turn the property <br />over to. <br />Crawford indicated that the City would be in a better <br />position to control some of these triings than Malsam <br />since the City can control the larger area. <br />Page 5 <br />
