MINUTES <br />CITY COUNCIL <br />NOVEMBER 25, 1992 <br />SIDEYARD Hanson opened the Public Hearing to consider an <br />SETBACK application for a 14-foot Variance for side yard <br />VARIANCE setback on a corner lot. The applicant is Gardner <br />90 ROSEWOOD Bros. Homes and the property location is 90 Rosewood <br />DRIVE Drive. The property in question is owned by Dr. George <br />Krienke. <br />Blesener pointed out that the property is question is <br />70 feet wide. The required minimum width for a corner <br />lot is 80 feet. Blesener asked why the City would <br />consider grantinq a variance of more than 10 feet. <br />The City Planner replied that prior to any platting or <br />development activity in this area, the lot was only 5 <br />feet non-conforming. Rosewood Drive was put in and <br />this property ended up a corner lot. Therefore, it was <br />the Planner's feeling that the action of platting the <br />street caused a development problem for this lot. The <br />Planner felt that despite the problems posed by the <br />platting of the street, the development plan for the <br />lot has tried to address the issues of the setback <br />oode. <br />Blesener asked if the developer were trying to place <br />too large a house on the lot. <br />The Planner did not believe so, and pointed out that <br />the house proposed is in character with the others in <br />the neighborhood. <br />There was no one present from the general public <br />wishing to comment on this matter. <br />Upon motion by Blesener, seconded by LaValle, the <br />public hearing was closed. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 92-11-428 - APPROVING A 14 FOOT VARIANCE <br />FOR SIDE YARD SETBACK FOR 90 ROSEWOOD DRIVE AS <br />REQUESTED BY THE PROPERTY OWNER, DR. GEORGE KRIENKE, <br />SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE <br />CITY PLANNER AND PLANNING COMMISSION AS OUTLINED IN TxE <br />PLANNER'S REPORTS DATED OCTOBER 5, 1992 AND NOVEMBER 9, <br />1992, AND BASED ON THE COMMENTS OF THE CITY PLANNER <br />THIS EVENING <br />The foregoing resolution was duly seconded by Collova. <br />Ayes (4) Blesener, Collova, Hanson, LaValle. <br />Nays (0).
