MINUTE5 <br />CITY COUNCIL <br />DECEMBER 15, 1992 <br />things. <br />Ray Buchholz, 120 Lake Street, reported that Roy Nadeau <br />donated the land for Nadeau Park to be used for a <br />wildlife park. Buchholz also reported that since <br />Little Canada took the streets over from the County, <br />there has been no sealcoating done. <br />Blesener pointed out that approximately five years ago <br />the Council held a hearing to consider the overlay of <br />Lake Street. The property owners opposed this proposal <br />even though the City informed them that without the <br />overlay the street would need reconstruction within the <br />next 3 to 5 years. <br />Blesener asked what the City Engineer has calculated as <br />assessable footage for Lots 1 and 2 along Lake Street. <br />The City Engineer pointed out that Lot 1 cannot be <br />divided since it does not front on Lake Street, <br />therefore, there is no assessment calculated for that <br />lot. It appears that Lot 2 can be divided. There is <br />limited frontage on the street, therefore, the City <br />Engineer is proposing an assessment equivalent to two <br />75 foot lots. <br />Barb McDonough, owner of Lot 2, pointed out that the <br />lot has only 50 feet of street frontage. <br />The City Engineer replied that the property is large <br />enough that it could be divided. There are also other <br />similar situations in the City where property has been <br />split even though there is limited frontage on the <br />street. <br />McDonough stated that she would oppose an assessment <br />for more than the actual footage that her property has <br />on Lake Street. <br />The City Administrator pointed out that the issue is <br />whether the access that the McDonouqh property has is <br />less valuable than anyone else~s access. The <br />Administrator pointed out that the City's minimum <br />frontage for a lot is 75 feet, therefore, that figure <br />was used in determining assessable footage for the <br />McDonough property. He agreed that only one lot should <br />be considered in this analysis due to the fact <br />insufficient frontage exists to create a second lot. <br />McDonough stated that she protested being assessed for <br />any more footage than she actually had. <br />The City Administrator pointed out that should the <br />improvement be ordered, the property owners being <br />assessed have the right to contest their assessment <br />Page 15 <br />
