MINUTES CITY COUNCIL DECEMBER 15, 1992 Scalze noted that the City wanted to let the market dictate the rent. Scalze stated that she has no problem with the concept being presented this evening, and noted that the City has already approved a Conditional Use Permit for bingo hall use of the property. Scalze's concerns were from a legal standpoint. Blesener felt concept approval was appropriate at this time, and suggested that the City Attorney can look into the legalities of the situation. Fahey suggested that he provide the City Attorney with copies of the lease agreement for his review. The City Administrator asked if the Council's intent was not to preclude a short-term dual license situation. Blesener agreed, but pointed out that the intent is for only one of the perhaps two bingo halls to be operating. LaValle agreed that in no instance would there be bingo occasions at two separate locations within the City. Fahey stated that he would explore this with TCF in depth. Fahey also asked if he could work with the City Attorney on this issue, if need be. Council agreed. Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION NO. 92-12-466 - DECLARING THAT IT IS THE CITY COUNCIL'S INTENT TO HAVE ONLY ONE BINGO xALL WITHIN THE CITY, AND THAT THE COUNCIL IS WILLING TO SUPPORT THE FOUR LICENSED CHARITIES IN THEIR EFFORTS TO OBTAIN A FAIR AND REASONABLE RENT AT WHICHEVER BINGO HALL, WITHIN THE CITY'S LEGAL RIGHTS TO DO S0, AND AUTHORIZING THE CITY ATTORNEY TO WORK WITH THE CHARITIES' LEGAL REPRESENTATIVE, IF NECESSARY The foregoing resolution was duly seconded by Scalze. Ayes (3) Blesener, Scalze, LaValle. Nays (o). Abstains (1) Hanson. Resolution declared adopted.
