MINUTES <br />CITY COUNCIL <br />DECEMBER 15, 1992 <br />Scalze noted that the City wanted to let the market <br />dictate the rent. Scalze stated that she has no <br />problem with the concept being presented this evening, <br />and noted that the City has already approved a <br />Conditional Use Permit for bingo hall use of the <br />property. Scalze's concerns were from a legal <br />standpoint. <br />Blesener felt concept approval was appropriate at this <br />time, and suggested that the City Attorney can look <br />into the legalities of the situation. <br />Fahey suggested that he provide the City Attorney with <br />copies of the lease agreement for his review. <br />The City Administrator asked if the Council's intent <br />was not to preclude a short-term dual license <br />situation. <br />Blesener agreed, but pointed out that the intent is for <br />only one of the perhaps two bingo halls to be <br />operating. <br />LaValle agreed that in no instance would there be bingo <br />occasions at two separate locations within the City. <br />Fahey stated that he would explore this with TCF in <br />depth. Fahey also asked if he could work with the City <br />Attorney on this issue, if need be. Council agreed. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 92-12-466 - DECLARING THAT IT IS THE <br />CITY COUNCIL'S INTENT TO HAVE ONLY ONE BINGO xALL <br />WITHIN THE CITY, AND THAT THE COUNCIL IS WILLING TO <br />SUPPORT THE FOUR LICENSED CHARITIES IN THEIR EFFORTS TO <br />OBTAIN A FAIR AND REASONABLE RENT AT WHICHEVER BINGO <br />HALL, WITHIN THE CITY'S LEGAL RIGHTS TO DO S0, AND <br />AUTHORIZING THE CITY ATTORNEY TO WORK WITH THE <br />CHARITIES' LEGAL REPRESENTATIVE, IF NECESSARY <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (3) Blesener, Scalze, LaValle. <br />Nays (o). <br />Abstains (1) Hanson.
