MINUTES <br />CITY COUNCIL <br />FEBRUARY 10, 1993 <br />Scalze again indicated that she felt the hearing should <br />be continued until after the Council revises the <br />assessment policy. <br />Pedersen pointed out that the reconstruction proposal <br />is for a standard City road. Pedersen felt that <br />anything less than standard would be a variance, and <br />economic reasons do not justify granting a variance. <br />Upon motion by LaValle, seconded by Morelan, the public <br />hearing on the improvement of Lake Street by <br />reconstruction was closed. LaValle, Morelan, Pedersen, <br />and Hanson voted in favor. Scalze voted against. <br />Morelan felt that the petition against the <br />reconstruction, which was signed by 100% of the <br />property owners, warranted looking at. Therefore, he <br />would be against the project at this point, but would <br />be willing to look at it aqain after the assessment <br />policy is revised. Morelan felt that changes in the <br />assessment policy would have a big bearing on this <br />improvement. Morelan pointed out that it might be <br />possible to include the reconstruction of Lake Street <br />with other City street projects planned for 1993 on a <br />change-order basis. <br />LaValle noted that 100% of the property owners on Lake <br />Street oppose the reconstruction. <br />Pedersen again pointed out that the reconstruction <br />would meet City minimum standards, and anything less <br />than that would be granting a variance for which there <br />is no justification other than economic. Pedersen <br />pointed out that the Engineer's estimate shows it is <br />not possible to do the grind and overlay and install <br />curb and gutter for $35.00 per front foot or less. <br />Morelan felt the question was whether the City wants to <br />offer an alternative to the policy. This is something <br />that will be addressed with the assessment policy. <br />The City Administrator pointed out that the Council has <br />closed the public hearing on the Lake Street <br />reconstruction, but is not obligated to make a decision <br />at this time. <br />The City Attorney pointed out that if the Council acts <br />on the improvement and it is denied, to consider the <br />same improvement will require going through the hearing <br />process again. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />Page 10 <br />
