<br />SECOND AMENDMENT TO MUNICIPAL MATERIALS MANAGEMENT AGREEMENT <br /> <br /> <br />THIS SECOND AMENDMENT TO MUNICIPAL MATERIALS MANAGEMENT <br />AGREEMENT (this “Second Amendment”) is entered into as of March 26, 2025 (the “Effective Date”), <br />the City of Little Canada, MN (“City”), and Allied Waste Services of North America, LLC, dba Republic <br />Services of the Twin Cities, a Delaware limited liability company, (“Republic”). <br />RECITALS <br />WHEREAS, the City and Services entered into that Municipal Materials Management <br />Agreement dated December 18, 2024, for the collection and disposal of garbage, yard waste, and bulky <br />items (“Agreement”); and <br /> <br />WHEREAS, the City and Republic entered into a First Amendment to modify certain terms of <br />the Agreement on January 8, 2025; and <br /> <br />WHEREAS, the City and Republic desire to enter into this Second Amendment to modify <br />certain terms of the Agreement; and <br /> <br />NOW THEREFORE, in consideration of the mutual promises and covenants contained in this <br />Second Amendment and other good and valuable consideration, the receipt of which is hereby <br />acknowledged, the parties covenant and agree as follows: <br /> <br />1. Exhibit A Section 4 is hereby amended (underlined and italics show new language): <br /> <br />4.4. Exemption to Service “Bulk Only Accounts” <br />The Company shall provide “Bulk Rate Only” collection for accounts listed under <br />Exemption to Service including: <br />o Residents who own a business or a rental property that is located within 25 miles <br />of the City of Little Canada. The property must have refuse collection that the <br />Little Canada resident is paying for and using for his/her own residential refuse. <br />The rental property must have at a minimum a two (2) yard container for disposal <br />service. The resident will still be required to enroll in recycling and bulky item <br />pickup services at contracted charges <br /> <br />o Residents who own a business but lease the business space. The resident will still <br />be required to enroll in recycling and bulky item. <br /> <br />2. Exhibit A Section 2.18 is hereby amended (underlined and italics show new language): <br />a. Yard Waste – Grass, leaves, flowers, stalks, stems, tree trimmings, branches, and tree <br />trunks. For yard waste collection services, grass, pine needles, leaves, flowers, stalks, <br />stems, and small tree trimmings (less than two (2) feet in length and less than two (2) inches <br />in diameter) shall be in a container, bag or box the weight of which shall not exceed thirty- <br />five (35) pounds. Larger tree trimmings shall be laid neatly in piles at curbside. The <br />maximum weight of any item placed out for yard waste collection shall be thirty-five (35) <br />pounds. Branches in excess of two (2) feet in length are not required to be in a container, <br />bag or box. New customers electing service in October or November will be subject to the <br />partial year charge noted above and must become full year's customers in the following
