MINUTES <br />CITY COUNCIL <br />MAY 12, 1993 <br />FRATTALONE Mr. Morelan introduced the following resolution and <br />RECYCLING moved its adoption: <br />OPERATION <br />RESOLUTION NO. 93-5-124 - BRINGING BACK TO TABLE THE <br />REQUEST OF FRANK FRATTALONE FOR EXTENSION FOR HIS <br />RECYCLING OPERATION LOCATED ON COUNTRY DRIVE <br />The foregoinq resolution was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Pedersen, Aanson, LaValle. <br />Nays (O). Resolution declared adopted. <br />The City Attorney reported that City records indicate <br />that the Council directed the preparation of a <br />development agreement with Mr. Frattalone addressing <br />his recycling operation on Country Drive which was <br />approved on July 25, 1990. On August 22, 1990 the City <br />Council passed Ordinance No. 335 which removed <br />stockpiling and recycling of more than 25 cubic yards <br />of aggregate and bituminous materials as a permitted <br />use in the I-1 Zoning District. On June 26, 1991 the <br />Council considered an extension of that development <br />agreement for two years, and approved that extension <br />the same date. The Attorney reported that it appears <br />the issue before the Council is the same extension that <br />was before the Council on June 26, 1991, and whether or <br />not the Council is interested in an extension. The <br />Attorney pointed out the May 7th memo from the City <br />Administrator on this matter. <br />Hanson read the Administrator's letter for the benefit <br />of the general public. Aanson asked if the Council <br />acted out of order in approving an extension in 1991 <br />when there was an ordinance in place prohibiting the <br />use. <br />The City Attorney stated that it was his belief that <br />the Council had the authority to approve an extension. <br />Frank Frattalone submitted a petition to the Council <br />which he indicated was signed by all but two of the <br />property owners in Ryan Industrial Park which states <br />that these property owners did not oppose a five-year <br />extension for the Frattalone recycle yard. Frattalone <br />indicated his willingness to build a building on the <br />site, and pointed out that after the last meeting he <br />has removed the equipment that was parked on the <br />stockpiles. Frattalone also reported that he discussed <br />the matter with Clete Busse, a property owner in the <br />park and member of the City's Community Pride <br />Committee, and showed Mr. Busse a plan for the site. <br />Frattalone described that plan for the Council which he <br />noted provided for additional berming on the north side <br />of the property.
