MINUTES <br />CITY COUNCIL <br />MAY 26, 1993 <br />COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY PLANNER <br />AS CONTAINED IN HIS REPORT AND SUBJECT TO TAE <br />DEDICATION OF 6 FOOT DRAINAGE AND UTILITY EASEMENTS <br />ALONG LOT LINES <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Morelan, LaValle, Hanson, Pedersen, Scalze. <br />Nays (O). Resolution declared adopted. <br />PUD Hanson opened the Public Hearing to consider the <br />2825 application for Planned Unit Development to allow the <br />COUNTRY DR. conversion of an existing residential structure to <br />FRANKLIN commercial office use and conversion of existing garage <br />DRYWALL to storage use submitted by Franklin Drywall for <br />property located at 2825 Country Drive. The Planning <br />Commission recommended approval of the PUD submit to <br />compliance with the recommendations of the City Planner <br />and allowing the existing garage to be raised <br />approximately 27 inches in height. <br />Scalze suggested that if the City is to approve this <br />PUD application, there should be some protection to the <br />City for the point in time that it may wish to purchase <br />the property for redevelopment. Scalze stated that she <br />did not want to see the City involved in paying <br />relocation costs when the applicant has stated at the <br />Planning Commission meeting that he is aware of the <br />intent of the City to see the property redeveloped. <br />Scalze asked if there should be a legal agreement or <br />language included in the PUD agreement to protect the <br />City since the property owner is aware that this would <br />be an interim use of the property. <br />Phil Franklin pointed out that he is bearing relocation <br />costs to move to the property. Franklin stated that as <br />long as he received fair market value for the property, <br />he would not have a problem with redevelopment. <br />The City Attorney suggested that the City could record <br />a document against the property whereby the purchase <br />price is established now for the acquisition at some <br />future date and the property owner would waive <br />relocation costs. <br />Hanson noted that this was not done with Precision <br />Tree. <br />Kim Weber, realtor representing Mr. Franklin, reported <br />that it is Mr. Franklin's intention to use the property <br />as an interim use and will cooperate with the City. <br />Weber reported that Franklin would be looking for a <br />fair purchase price for the property. <br />Page 11 <br />
