It was noted
COUNTY RD. C that the Planning Commission has recommended approval
ERICKSON of the property division as presented and that the
division meets all minimum City Code requirements.
Morelan asked about the Planner's comment in his report
that the legal interpretation of frontage would be that
the existing house faced Stark Street.
The City Planner replied that the Code takes the
position that the narrowest frontage of a corner lot is
considered the street frontage. Setbacks on a corner
lot are 30 feet for the front and 30 feet for the
sideyard along the street. In the case of this
existing house at 46 East Old County Road C, the house
was placed approximately 3/4ths of a foot too close to
the street. However, this is an existing condition
that does not effect the property division.
Mr. Morelan introduced the ~ollowing resolution and
moved its adoption:
RESOLUTION NO. 93-5-144 - APPROVING TIiE DIVISION OF
PROPERTY AT 46 EAST OLD COUNTY ROAD C INTO TWO LOTS AS
REQUESTED BY JOHN AND NADEAN ERICKSON SUBJECT TO
Page 10
