MINUTES <br />CITY COUNCIL <br />JULY 14, 1993 <br />LaValle pointed out that the improvement can be ordered <br />and the assessment deferred until such time as the <br />property is developed. <br />Morelan did not feel Swanson should be assessed for any <br />more than his land contributes to the run-off problem. <br />The City Administrator pointed out that Mr. Swanson has <br />acknowledged the need for storm sewer, and suggested <br />that staff prepare some alternatives for spreading the <br />cost of the project for consideration at the assessment <br />hearing. The Administrator again pointed out the the <br />key test in any assessment is the benefits received <br />issue. <br />There was no one else from the qeneral public present <br />wishing to comment on this matter. <br />Upon motion by LaValle, seconded by Scalze, the public <br />hearing was closed. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 93-7-204 - ORDERING IMPROVEMENT NO. <br />93-7, LITTLE CANADA ROAD STORM SEWER IMPROVEMENT, AND <br />AUTHORIZING THE CITY ENGINEER TO PREPARE PLANS AND <br />SPECIFICATIONS <br /> The foreqoing resolution was duly seconded by Scalze. <br /> Ayes (5) LaValle, Scalze, Hanson, Pedersen, Morelan. <br /> Nays (0). Resolution declared adopted. <br />VACATION OF The Mayor opened the public hearing to consider the <br />DRAINAGE & vacation of drainage and utility easements over the <br />UTILITY south six feet of Lots 1 and 2, Block 3, Costa <br />EASEMENTS Estates Third Addition. It was noted that the property <br />LOTS 1 AND 2, owner recently combined these two lots with adjacent <br />BLOCK 3 property, therefore, the drainage and utility <br />COSTA ESTATES easements in question would run through the center of <br /> the lots. <br /> There was no one from the general public present <br /> wishing to comment on this matter. <br /> Upon motion by Scalze, seconded by Hanson, the public <br /> hearing was closed. <br /> Mrs. Scalze introduced the following resolution and <br /> moved its adoption: <br /> RESOLUTION N0. 93-7-205 - VACATING THE DRAINAGE AND <br /> UTILITY EASEMENTS OVER THE SOUTH SIX FEET OF LOTS 1 AND <br /> 2~ BLOCK 3, COSTA ESTATES THIRD ADDITION <br /> Page 6 <br />
