MINUTES <br />CITY COUNCIL <br />J'ULY 28, 1993 <br />Pedersen felt that the Council needed to listen to the <br />people already living in the area since they are the <br />ones that have to live with the development once it is <br />completed. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 93-7-237 - DENYING THE CONCEPT FOR <br />TOWNHOME DEVELOPMENT ON THE MITCHELL PROPERTY LOCATED <br />IN LITTLE CANADA AND THE CONCEPT OF REZONING FROM R-1 <br />TO R-2 BASED ON THE COMMENTS OF THE EXISTING <br />NEIGHBORHOOD AND BASED ON THE FACT THAT THE CITY'S <br />COMPREHENSIVE PLAN IDENTIFIES THE ZONING FOR THE AREA <br />AS R-1 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Scalze, LaValle, Hanson, Pedersen, Morelan. <br />Nays (0). Resolution declared adopted. <br />OSI.AND Mr. Norm Osland appeared before the Council requesting <br />MATTIIt reimbursement for attorney's fees and photography <br />expenses associated with the development of the <br />Rosewood Drive area just south of his property. Osland <br />expressed concern with the City Administrator's letter <br />outlining Osland's request, and asked that the <br />Administrator read that letter to the Council. <br />The City Administrator read his letter dated July 23, <br />1993 which was included in the Council's agenda packet. <br />The letter outlined Mr. Osland's request, cautioned the <br />City Council about the possibility of setting a <br />precedent and suggested that the Council may wish to <br />seek the City Attorney's opinion in this matter. <br />Osland pointed out that he is a citizen of Ramsey <br />County, a resident of the City for 29 years, and a <br />taxpayer, and that the City Administrator is not. <br />Osland asked how the City Administrator can act as <br />judge and jury in this matter. <br />The City Administrator pointed out that he has <br />presented Mr. Osland's request to the Council, and it <br />was his job to point out the issues to the Council. <br />Osland reported that he has met with the City <br />Administrator on 12 to 15 occasions regarding the <br />drainage work that was to be done as part of the <br />Rosewood Drive development. This work is still not <br />completed, and Osland indicated that all the run-off is <br />coming onto his property. <br />Page 19 <br />
