MINUTES <br />CITY COUNCIL <br />JUI,Y 28, 1993 <br />LaValle felt the violation by Tierney's was an innocent <br />one and that any fine imposed should be suspended if <br />there are no other opening violations in the next year. <br />Morelan did not believe the citizens of Little Canada <br />were hurt by the violation and felt competitors were <br />not hurt due to the fact that Tierney's indicated there <br />was very little business that day. <br />The City Administrator reported that when the City <br />became aware of the violation, Tierney~s was contacted <br />and the owners have been extremely cooperative and <br />forthcoming about the incident. It appears the <br />incident was an oversight on their part and will not be <br />repeated based on past practice. <br />Pedersen felt there should be some fine imposed, noting <br />that an innocent speeding violation, for example, <br />results in a fine. <br />Lendway noted that the court has put Tierney's on a <br />year~s probation. <br />The City Administrator agreed that Tierney's was fined <br />in the court proceedings, and have not walked away <br />without any penalty. <br />Pedersen indicated that his feeling was that the City <br />should impose a civil penalty in this matter, even if <br />it is only a token penalty. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-7-236 - IMPOSING A$100.00 CIVIL <br />PENALTY IN THE TIERNEY'S LIQUOR VIOLATION AND <br />SUSPENDING THAT PENALTY FOR ONE YEAR IF THERE ARE NO <br />SUBSEQUENT OPENING VIOLATIONS <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (4) LaValle, Scalze, Hanson, Morelan. <br />Nays (1) Pedersen. Resolution declared adopted. <br />CONCEPT Mr. Len Pratt, Pratt Homes, appeared before the <br />REVIEW - Council presenting a proposal for development of 26 <br />PRATT townhomes on the Mitchell property located on Vadnais <br />AOMES Blvd. in Little Canada. Pratt reported on the history <br />TOWNHOME of Pratt Homes pointing out they have been developers <br />DEtIELOPMENT of single-family and townhomes in the northeast suburbs <br />PROPOSAL for the past 21 years. Pratt submitted information to <br />the Council on townhome association documents and the <br />types of conditions that can be included in such <br />Page 9 <br />
