MINU'PES <br />CITY COUNCIL <br />AUGUST 25, 1993 <br />Ordinance as it governs space where alcohol sales and <br />consumption is allowed. <br />LaValle felt that liquor consumption was another issue <br />and pointed out that the CUP was a formality since <br />Gordies had volleyball prior to the ordinance <br />amendment. LaValle felt that the CUP should be <br />approved since it is a benefit to an existing business <br />and the community, and since volleyball has been played <br />at Gordies for the past 15 years. <br />Scalze indicated that she did not recall any discussion <br />of volleyball at Gordies prior to 2 or 3 years ago. <br />The City Attorney pointed out that any future amendment <br />to the City's liquor ordinance would have to be <br />complied with by Gordies as well as any existing liquor <br />establishment. <br />Scalze felt that sooner or later the Council must take <br />charge of where alcohol is sold and consumed. <br />Morelan asked if it were legal for someone to sit in <br />their car and consume alcohol in the parking lot of a <br />liquor establishment. <br />The City Attorney replied that he was looking for a <br />prohibition to consuming alcohol on a premise without <br />having bouqht the liquor there. The Attorney suggested <br />that such a provision would prohibit someone bringing a <br />cooler of alcoholic beverages to a volleyball game. <br />Hanson asked about the fund-raiser recently held at the <br />Venetian Inn by Little Canada Charity Plus. <br />The City Administrator replied that under the City's <br />Liquor Ordinance, no permit was required since the <br />Ordinance allows consumption on the premises and does <br />not restrict consumption to within the structure. The <br />Administrator reported that the Little Canada Charity <br />fund-raiser was handled in the same manner as the <br />Venetian Inn boxing matches. There are other cities, <br />however, who do limit alcohol sales and consumption to <br />within the building. <br />The Administrative Assistant reported that the City of <br />White Bear Lake's liquor ordinance prohibits the sale <br />and consumption of alcohol outside the building unless <br />the property owner has a special use permit. Under the <br />special use permit process, the City then requires <br />controls over outdoor sales and consumption. For <br />example, the Village Inn has outdoor sales and <br />Page 6 <br />
