MINUTES <br />CITY COUNCIL <br />OCTOBER 13, 1993 <br />assessment for the dividable lot can be deferred until <br />such time as the property is sold. There are <br />approximately 4 properties that would qualify for the <br />development deferment under the Edgerton project and 2 <br />or 3 under the Vanderbie/Allen project. Another option <br />would be to delete the assessment for the second lot <br />and charge it as a connection charge at the time that <br />the property is divided. <br />Morelan pointed out that deleting the assessment and <br />using the connection charge does not put a potential <br />buyer on notice of this charge. <br />The City Administrator replied that that was correct. <br />Under the deferment option, the water main assessment <br />for the second lot would show up in a title search. <br />However, the City's ordinance does allow for water <br />connection charges to be increased to reflect the cost <br />of previous water main improvements. <br />The Administrator again pointed out that under the <br />deferred assessment option, the assessment would show <br />up on a title search, while under the water connection <br />charge, it would not. Interest would accrue, however, <br />under either option. <br />Morelan felt that the Michelson situation was unique in <br />that a property sale is in the process of occurring. <br />Scalze felt the water connection fee option should be <br />limited to properties with the ability to be split in <br />two and not five. Scalze agreed that in the Michelson <br />case the situation is different since there is a sale <br />in progress and a purchase agreement has been signed. <br />Morelan pointed out that either option, deferring the <br />assessment or the water connection fee, was of no more <br />benefit over the other. Interest accrues under either <br />option. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-10-332 - DELETION OF $1,448.94 FROM <br />THE MICHELSON WATER MAIN ASSESSMENT, WHICH REPRESENTS <br />THE WATER SERVICE FOR THE DIVIDABLE LOT, IN RECOGNITION <br />OF THE MICHELSON OBJECTION TO THE ASSESSMENT, AND <br />DECLARING THAT THIS $1,448.94 WILL BE TREATED AS A <br />WATER CONNECTION FEE, WITH SIMPLE INTEREST TO ACCRUE, <br />TO BE PAID AT SUCH TIME AS THE PROPERTY IS SUBDIVIDED <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Hanson, Pedersen, LaValle. <br />Nays (0).
