MINUTES <br />CITY COUNCIL <br />OCTOBER 27, 1993 <br />The City Attorney noted that two of the billboards <br />appear to be located on State Trunk Highway <br />right-of-way. In 1988 there was a case where Naegele <br />was required to remove 13 signs from highway <br />right-of-way, and Naegele was compensated $380,000 for <br />those signs. The Attorney reported that there are <br />both real and personal property rights involved in this <br />situation, and the courts have deemed both to be <br />compensable. The Attorney reported that the City can <br />enforce the ordinance, however, there will be a cost <br />involved. <br />Scalze pointed out that the billboard was constructed <br />under a Conditional Use Permit sometime in the Fall of <br />1978. Saalze suggested that the minutes be reviewed <br />pertaining to this action to determine if there were <br />any conditions placed on the CUP. <br />PRELIMINARY Hanson opened the continuation of public hearing for <br />PLAT the preliminary plat of Canada Woods West which <br />CANADA consists of 12-single family lots. Aanson noted that <br />WOODS WEST the Planning Commission has recommended approval of the <br />preliminary plat subject to compliance with the <br />recommendations of the City Planner. <br />Ken Gust, representing the developer, appeared before <br />the Council and reported that after initial review of <br />the proposal by the Planning Commission, there were <br />three issues that needed to be addressed. The first <br />was review of the plat by the Park Commission. The <br />Park Commission has reviewed the plat and recommended <br />acceptance of dedication of property under the <br />powerline easement, as well as walkway easement from <br />the end of the cul-de-sac for future connection to the <br />east. The second issue regarded utilities. Gust <br />reported that he has met with the City Engineer and the <br />Public Works Superintendent, and preliminary utility <br />designs have been done for connection to Little Canada <br />utilities. This connection will include a sewer lift <br />station. The third issue regarded the wetland, and <br />Gust reported that the pond originally planned for the <br />southwest corner of the plat has been relocated to the <br />east side of the cul-de-sac. The pond will be a <br />treatment pond which will slow down flows. There will <br />be an outlet pipe in the pond and flows will continue <br />into the existing swale in the area and eventually into <br />Kohlman Lake. <br />Scalze asked if the swale would cross private <br />property. <br />Gust reported that it would, and that this was <br />Page <br />
