MINUTES CITY COUNCIL NOVEMBER 24, 1993 recoverable in the absence of showing that the lawsuit was brought frivolously or in bad faith. The City Attorney reported that the City has been served with the objection just this evening. Therefore, he recommended that the assessment hearing be continued until the next regular Council meeting at which time he will report back to the City Council as to the merits or lack thereof of the objection. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION NO. 93-11-267 - CONTINUING THE ASSESSMENT HEARING FOR IMPROVEMENT NO. 92-6 UNTIL THE DECEMBER 8, 1993 REGULAR COUNCIL MEETING The foregoing resolution was duly seconded by Scalze. Ayes (5) LaValle, Scalze, Pedersen, Hanson, Morelan. Nays (O). Resolution declared adopted. ASSESS~iT The Mayor opened the assessment hearing for Improvement HEARING No. 91-10, 2558 Rice Street, by hazardous structure 2558 RICE demolition. The Mayor noted that there was no one from STREET the general public present wishing to comment on this matter. The City Administrator reported that the hazardous building at 2558 Rice Street was removed pursuant to the hazardous building statute. The cost associated with that removal was $8,476. The Administrator reported that since there is no one present wishing to comment on this matter, the public hearing could be closed, and the Council can certify the assessment. The City Attorney agreed. Upon motion by Morelan, seconded by LaValle, the public hearinq was closed. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION NO. 93-11-268 - ADOPTING THE ASSESSMENT ROLL FOR IMPROVEMENT NO. 91-10, REMOVAL OF HAZARDOUS STRUCTURE FROM 2558 RICE STREET, IN THE AMOUNT OF $8,476.00 AND CERTIFYING THE ASSESSMENT TO RAMSEY COUNTY The foregoing resolution was duly seconded by Morelan. Ayes (5) LaValle, Morelan, Pedersen, Scalze, Hanson. Nays (0). Resolution declared adopted. Page 3
