MINUTES <br />CITY COUNCIL <br />NOVEMBER 24, 1993 <br />recoverable in the absence of showing that the lawsuit <br />was brought frivolously or in bad faith. <br />The City Attorney reported that the City has been <br />served with the objection just this evening. <br />Therefore, he recommended that the assessment hearing <br />be continued until the next regular Council meeting at <br />which time he will report back to the City Council as <br />to the merits or lack thereof of the objection. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-11-267 - CONTINUING THE ASSESSMENT <br />HEARING FOR IMPROVEMENT NO. 92-6 UNTIL THE DECEMBER 8, <br />1993 REGULAR COUNCIL MEETING <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Pedersen, Hanson, Morelan. <br />Nays (O). Resolution declared adopted. <br />ASSESS~iT The Mayor opened the assessment hearing for Improvement <br />HEARING No. 91-10, 2558 Rice Street, by hazardous structure <br />2558 RICE demolition. The Mayor noted that there was no one from <br />STREET the general public present wishing to comment on this <br />matter. <br />The City Administrator reported that the hazardous <br />building at 2558 Rice Street was removed pursuant to <br />the hazardous building statute. The cost associated <br />with that removal was $8,476. The Administrator <br />reported that since there is no one present wishing to <br />comment on this matter, the public hearing could be <br />closed, and the Council can certify the assessment. <br />The City Attorney agreed. <br />Upon motion by Morelan, seconded by LaValle, the public <br />hearinq was closed. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-11-268 - ADOPTING THE ASSESSMENT ROLL <br />FOR IMPROVEMENT NO. 91-10, REMOVAL OF HAZARDOUS <br />STRUCTURE FROM 2558 RICE STREET, IN THE AMOUNT OF <br />$8,476.00 AND CERTIFYING THE ASSESSMENT TO RAMSEY <br />COUNTY <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (5) LaValle, Morelan, Pedersen, Scalze, Hanson. <br />Nays (0).
