Peat materials are taken <br />from a site and mixed at the recycling yard with other <br />materials to make a usable top soil. <br />The City Administrator reported that the sand and Class <br />V fall under the definition of aqgregate materials. <br />Frattalone reported that there are different types of <br />black dirt. There is peat which is not a good top <br />soil. Peat is taken and mixed with sand and top soil <br />and run through a shredder. It can then be sold as top <br />soil. Frattalone reported that he stockpiles the peat <br />material and mixes it at the recycling site as he sells <br />it. Frattalone also reported that his recycling yard <br />processes street sweepings for the City. Street <br />sweepings are screened so that they can be reused as <br />sand. If street sweepings are not recycled, they must <br />go to a landfill. <br />Morelan asked if there were environmental issues <br />associated with used street sweepings. <br />Frattalone replied that there were and that is the <br />reason the City brings the sweepings in to be recycled. <br />Frattalone noted that he does not store the sweepings <br />on his site. <br />Pedersen asked how the Frattalone black dirt stockpile <br />was different than what Mr. Mogren requested to do on <br />his property. <br />The City Administrator pointed out that the Frattalone <br />operation is covered by an agreement with a termination <br />date. <br />Scalze pointed out that the Frattalone operation is not <br />a permitted use, however, the City is allowing it to <br />continue with a termination date. <br />Frattalone asked what the processing and selling of <br />black dirt fell under, and asked if there was something <br />he should be doing to ensure that he could continue his <br />black dirt business. <br />The Administrator replied that the issue is that there <br />is no principle building on the site. If there were a <br />principle building, a Conditional Use Permit could be <br />granted for the operation. The issue is the lack of a <br />building on the site. <br />Scalze pointed out that the City's extension of the <br />time period for allowinq the recycling operation was <br />subject to construction of a building on the site <br />within a specific time period. <br />Page 8 <br />
