MIN[TPES <br />CITY COUNCIL <br />JANUARY 12, 1994 <br />ADMINISTRATOR, REPRESENTATIVES OF THE RAMSEY COUNTY <br />SHERIFF'S DEPARTMENT, MAYOR AND COUNCIL MEMBER LAVALLE, <br />TO DISCUSS ALTERNATIVE POLICING OPTIONS AT THE SCHOOL <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) LaValle, Pedersen, Hanson, Morelan, Scalze. <br />Nays (O). Resolution declared adopted. <br />FRATTAIANE The City Administrator reported that last week a <br />RECYCLING siqnificant amount of fill was removed from the Gervais <br />OPERATION Mill site and some of it was hauled to the Frattalone <br />recycling operation on County Drive. The Administrator <br />reported that in reviewing the Recycling Agreement, it <br />does not appear to allow the stockpiling of black dirt <br />on the site since the agreement talks about aggregate <br />materials. <br />The Administrator reported that the Building Official <br />discussed this with Mr. Frattalone, who indicated that <br />he felt the intent of the agreement was to allow the <br />black dirt stockpiling. Black dirt is shown on the <br />site plan which Mr. Frattalone presented to the City <br />when the recycling operation was discussed in 1989 and <br />1990. The Administrator reported that Mr. Frattalone <br />was informed that for the black dirt.to be allowed to <br />be stockpiled on the property, either a fill permit <br />would have to be issued, or the Recycling Agreement <br />would have to be amended. <br />The Administrator indicated that it <br />omission of reference to black dirt <br />Agreement was an oversight. Frattalone stated that he <br />assumed that black dirt was covered under the <br />agreement, and pointed out that black dirt has always <br />been a part of his business. <br />Morelan stated that he had no problem with allowing the <br />black dirt to remain if it were truly an oversight in <br />the agreement. However, he did not see the connection <br />with black dirt and recycling. Morelan asked about the <br />sand and Class V which is also stockpiled on the site. <br />Frattalone replied that black dirt, sand, and Class V <br />are all a part of recycling. Frattalone pointed out <br />that black dirt is mixed with sand to make a usable <br />Page 7 <br />
