MINU`PES <br />CITY COUNCIL <br />;fANUARY 26, 1994 <br />Morelan pointed out that the clear title to the <br />property allows the City to look at the Rue request for <br />use of a portion of the property for parking. <br />The City Administrator recommended that the matter be <br />discussed by the Park & Recreation Commission in light <br />of the information provided by the City attorney. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 94-1-30 - REFERRING THE DON RUE REQUEST <br />FOR USE OF PUBLIC PROPERTY FOR PARKING TO THE PARK AND <br />RECREATION COMMISSION FOR A RECOMMENDATION <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (4) LaValle, Pedersen, Hanson, Morelan. <br />Nays (O). Resolution declared adopted. <br />M`1`C The City Administrator reviewed an agreement forwarded <br />AGREEMENTS by MTC relating to maintenance of bus service, bus <br />zones and bus stop signs as well as an agreement <br />regarding bus stop signage. The Administrator reported <br />that the agreements detail the City's responsibility <br />for maintaining bus stops as well as providing <br />handicapped accessibility. These agreements are the <br />result of a lawsuit in another city, and the League of <br />Minnesota Cities Insurance Trust has been heavily <br />involved in the drafting of these agreements which <br />define liability responsibilities. <br />The Administrator reported that the goal of the MTC is <br />to get 90% of bus stops properly signed, and the MTC <br />will reimburse cities for the cost of sign installation <br />under ISTEA grant funds. The work associated with <br />providing handicapped accessibility at bus stops will <br />not be required immediately. The MTC will be seeking <br />additional grant funds to help offset these future <br />costs. <br />Morelan pointed out the small percentage of residents <br />which utilize bus service, stating that it doesn't seem <br />right that all residents have to pay costs associated <br />with a service utilized by relatively few people. <br />The City Administrator stated that Statute provides for <br />assignment of responsibility, and it is a given fact <br />that few bus stop siqns exist. The MTC will provide <br />the signs, and it is the City's responsibility to <br />install the signs. The goal is to place bus stop signs <br />on existing street signs to minimize costs. <br />Paqe 11 <br />
