MINUTES
CITY COUNCIL
APRIL 27, 1994
would not be proper to handle the request as a variance.
Pedersen stated that if the proposal is a good idea, it
should be handled as an ordinance amendment.
Morelan asked if a 20 foot rear yard setback was standard
for an I-P zoning district.
The Planner replied that it was. The Planner recommended
that if the Council feels the encroachment proposed is
appropriate, the request should be handled as an
ordinance amendment rather than a variance.
Morelan pointed out that if the variance is approved, any
property owner with the same circumstances will be in to
the City asking for a similar variance.
Hanson pointed out the need for setbacks between
buildings for access by emergency vehicles. Hanson again
stated that the City Planner has indicated that the
request does not meet the necessary criteria for a
variance.
There was no one from the general public present wishing
to comment on this matter.
Upon motion by Morelan, seconded by Scalze, the public
hearing was closed.
Mr. Morelan introduced the following resolution and moved
its adoption:
RESOLUTION NO. 94-4-106 - DENYING THE REQUEST FOR
VARIANCE TO ALLOW ENCROACHMENT OF A BUILDING INTO THE
REAR YARD SETBACK AS REQUESTED BY NORTHERN AIR
CORPORATION, 75 SOUTA OWASSO BLVD., BECAUSE THE REQUEST
DOES NOT MEET TAE AARDSHIP CRITERIA FOR A VARIANCE
The foregoing resolution was duly seconded by Scalze.
Ayes (5) Morelan, Scalze, Hanson, Pedersen, LaValle.
Nays (0).
