MINUTES <br />CITY COUNCIL <br />APRIL 27, 1994 <br />would not be proper to handle the request as a variance. <br />Pedersen stated that if the proposal is a good idea, it <br />should be handled as an ordinance amendment. <br />Morelan asked if a 20 foot rear yard setback was standard <br />for an I-P zoning district. <br />The Planner replied that it was. The Planner recommended <br />that if the Council feels the encroachment proposed is <br />appropriate, the request should be handled as an <br />ordinance amendment rather than a variance. <br />Morelan pointed out that if the variance is approved, any <br />property owner with the same circumstances will be in to <br />the City asking for a similar variance. <br />Hanson pointed out the need for setbacks between <br />buildings for access by emergency vehicles. Hanson again <br />stated that the City Planner has indicated that the <br />request does not meet the necessary criteria for a <br />variance. <br />There was no one from the general public present wishing <br />to comment on this matter. <br />Upon motion by Morelan, seconded by Scalze, the public <br />hearing was closed. <br />Mr. Morelan introduced the following resolution and moved <br />its adoption: <br />RESOLUTION NO. 94-4-106 - DENYING THE REQUEST FOR <br />VARIANCE TO ALLOW ENCROACHMENT OF A BUILDING INTO THE <br />REAR YARD SETBACK AS REQUESTED BY NORTHERN AIR <br />CORPORATION, 75 SOUTA OWASSO BLVD., BECAUSE THE REQUEST <br />DOES NOT MEET TAE AARDSHIP CRITERIA FOR A VARIANCE <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Hanson, Pedersen, LaValle. <br />Nays (0). Resolution declared adopted. <br />PUBLIC Hanson opened the public hearinq for consideration of <br />HEARING preliminary and final plat approval for Quicksilver. <br />PRELIMINARY Hanson pointed out that the preliminary and final <br />& FINAL plat was recommended for approval by the Planning <br />20 <br />
