MINUTES <br />CITY COUNCIL <br />MAY 25, 1994 <br />petition for an improvement. <br />Morelan suggested that Lake Street be improved and the <br />assessments for the improvement be deferred, with the <br />exception of Keenan's, until the other properties <br />develop. <br />Tom Keenan stated that with regard to the concerns <br />about emergency vehicle access, there are other <br />properties in the City serviced by long driveways. <br />Keenan reported that a portion of the driveway on the <br />Lake Street right-of-way is not paved, and suqgested <br />that the City could require additional paving to <br />address that concern. <br />Scalze pointed out the property division the City <br />approved a couple of years ago on County Road B-2. <br />Scalze suggested that emergency vehicle access concerns <br />would be greater in that situation. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 94-5-123 - APPROVING THE VARIANCE TO <br />CONSTRUCT A HOME ON PROPERTY WITHOUT FRONTAGE ON AN <br />IMPROVED STREET AS REQUESTED BY KEVIN KEENAN FOR LOTS <br />10 AND 11, MASON MANOR BASED ON THE COUNCIL~S POSITION <br />THAT A HARDSHIP EXISTS SINCE THE APPLICANT DOES NOT <br />HAVE ADEQUATE FRONTAGE TO PETITION FOR PUBLIC <br />IMPROVEMENT OF LAKE STREET, SUBJECT TO THE CITY'S <br />POSITION THAT SHOULD THE CITY RECEIVE A REQUEST FOR <br />ANOTHER DWELLING ON THAT STREET, THE COUNCIL WILL ORDER <br />THE IMPROVEMENT OF LAKE STREET, SUBJECT TO MR. KEENAN <br />SIGNING A WAIVER OF RIGHT TO APPEAL ASSESSMENTS FOR <br />SUCA IMPROVEMENT, SUBJECT TO COMPLIANCE WITH THE <br />ALTERNATIVES RECOMMENDED BY THE CITY PLANNER IN HIS <br />REPORT DATED MAY 9, 1994, AND SUBJECT TO MR. KEENAN <br />ENTERING INTO A HOLD HARMLESS/LICENSE AGREEMENT <br />ADDRESSING CITY LIABILITY CONCERNS WITH THE USE OF A <br />PUBLIC ROAD RIGHT-OF-WAY AS A DRIVEWAY <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (4) LaValle, Pedersen, Hanson, Scalze. <br />Nays (ij Morelan.
