MINUTES CITY COUNCIL MAY 25, 1994 Pedersen stated that a variance is not as simple a request as it might appear, pointing out that the request must meet legal standards. Morelan felt that legal concerns as well as emergency vehicle access concerns were valid. Morelan asked who would be responsible for maintaining the roadway. Morelan stated that he could not support the variance request. Pedersen felt an agreement between the City and Keenan addressing the private drive and the fact that the City would not be responsible for maintenance of that drive should be a condition of approval. Pedersen pointed out that Keenan should also be aware that in two years the City could decide to improve Lake Street, and he would then be responsible for paying his share of the improvement costs. Scalze felt a hold harmless agreement was needed between the City and Keenan absolving the City from liability and maintenance, and addressing concerns about emergency vehicle access. Pedersen agreed that such an agreement was necessary. Morelan felt that access concerns could not be adequately addressed. Pedersen pointed out that there is already a long driveway on the easement providing access for 764 LaBore Road. Tom Mason reported that the driveway has been in use for about 30 years. Mason reported that he had no problem with the Keenan variance request, and felt it was the best way to address the situation. Mason felt that the Council was trying to legislate something that has existed for 30 years, and felt the existing situation was grandfathered in. Scalze pointed out that the Keenan proposal is to add a second house to that driveway access. Morelan pointed out that there is nothing non- conforming with the situation at 764 LaBore Road other than the fact that the property owner is using the City 7
