MINUTES <br />CITY COUNCIL <br />MAY 25, 1994 <br />Pedersen stated that a variance is not as simple a <br />request as it might appear, pointing out that the <br />request must meet legal standards. <br />Morelan felt that legal concerns as well as emergency <br />vehicle access concerns were valid. Morelan asked who <br />would be responsible for maintaining the roadway. <br />Morelan stated that he could not support the variance <br />request. <br />Pedersen felt an agreement between the City and Keenan <br />addressing the private drive and the fact that the City <br />would not be responsible for maintenance of that drive <br />should be a condition of approval. Pedersen pointed <br />out that Keenan should also be aware that in two years <br />the City could decide to improve Lake Street, and he <br />would then be responsible for paying his share of the <br />improvement costs. <br />Scalze felt a hold harmless agreement was needed <br />between the City and Keenan absolving the City from <br />liability and maintenance, and addressing concerns <br />about emergency vehicle access. <br />Pedersen agreed that such an agreement was necessary. <br />Morelan felt that access concerns could not be <br />adequately addressed. <br />Pedersen pointed out that there is already a long <br />driveway on the easement providing access for 764 <br />LaBore Road. <br />Tom Mason reported that the driveway has been in use <br />for about 30 years. Mason reported that he had no <br />problem with the Keenan variance request, and felt it <br />was the best way to address the situation. Mason felt <br />that the Council was trying to legislate something that <br />has existed for 30 years, and felt the existing <br />situation was grandfathered in. <br />Scalze pointed out that the Keenan proposal is to add a <br />second house to that driveway access. <br />Morelan pointed out that there is nothing non- <br />conforming with the situation at 764 LaBore Road other <br />than the fact that the property owner is using the City <br />7 <br />
