MINUTES <br />CITY COUNCIL <br />JUNE 22, 1994 <br />that the Jackson Street trail would run between the <br />Zietlow and Judd properties, and waite believed that <br />Morelan was related to Mr. Zietlow. <br />Morelan indicated that he was not related to Mr. <br />Zietlow, and stated that should vacation of the Jackson <br />Street trail easement become an issue, he would abstain <br />from voting on the matter. Morelan agreed that would <br />be a direct conflict of interest. However, he did not <br />feel discussion of the sidewalk and trail improvements <br />were a conflict, but would agree to abstain from voting <br />on the matter if a number of residents agreed with Mr. <br />Waite's position. <br />Several residents raised their hands indicating their <br />agreement with Mr. Waite~s comments. <br />Hanson reported that the City Engineer has informed him <br />that the proposed Jackson Street trail improvement <br />would go on the City's right-of-way. Hanson asked if <br />the trail were improved, if it would be installed at <br />City cost and not assessed against property owners in <br />the area. <br />The City Administrator replied that it would be staff's <br />recommendation that the trail improvement not be <br />assessed. The City has not directly assessed property <br />owners for trail improvements in the past. <br />Morelan asked about assessing a sidewalk improvement. <br />The Administrator noted the survey which staff did of <br />cities in the area. This survey shows that the trend <br />is to not assess sidewalks because of the benefits <br />received issue, although there are some cities which <br />have assessed sidewalk improvements. <br />Morelan suggested that it may change the feeling of the <br />property owners if the sidewalk was put in at no <br />charge. <br />Hanson pointed out the question of liability to the <br />property owner, and assumed that the sidewalk would be <br />installed on street right-of-way rather than on private <br />property. <br />The City Attorney replied that typically sidewalks are <br />put in on street right-of-way, with the adjacent <br />12 <br />
