MINUTES <br />CITY COUNCIL <br />NI~Y 13, 1994 <br />areas are somewhat questionable, and the project would <br />be affected should there be a lot of rain in the fall. <br />Finally, it would be difficult to assess these projects <br />this year due to the timing for the submission of <br />assessment information to the County and the fact that <br />the projects may not be completed within that <br />timeframe. <br />The City Administrator also reported that the City has <br />received a petition signed by some of the property <br />owners in the area asking the Council to reconsider its <br />position on the Jackson Street trail improvement. <br />Rejecting the street bids will give the City additional <br />time to consider this issue. <br />Hanson pointed out that the trail is part of the street <br />improvement project. If bids are rejected, the trail <br />construction would be delayed until such time as the <br />street project proceeds. <br />The Administrator reported that the City Engineer has <br />indicated that the street improvements could proceed <br />this year and be constructed properly. However, he <br />does understand the concerns outlined and shares some <br />of them. <br />Aanson pointed out that rejecting the bids is to the <br />benefit of the property owners involved. The City <br />would hope to obtain lower bids early in 1995 with <br />these initial bids establishing a baseline for <br />assessments. <br />The Administrator reported that the City could <br />calculate the assessment that the property owners would <br />have received under the low bid from Ashbach <br />Construction, using the standard 8'~ and 3" road <br />section. The Administrator recommended that the City <br />take the position that the assessment for the <br />improvements would be no higher than the assessment <br />which would have been passed on to the property owners <br />given the Ashbach bid. The Administrator also pointed <br />out that the City is obtaining appraisals establishing <br />the benefits received to the property owners as a <br />result of the improvement, and these appraisals would <br />help determine the assessment rate irrespective of the <br />bid price. The Administrator did not feel the City <br />would take a great deal of exposure guaranteeing that <br />the assessment rate would not exceed that which would <br />10 <br />
