MINUTES <br />CITY COUNCIL <br />JULY 13, 1994 <br />RESOLUTION NO. 94-7-170 - CALLING A CLOSED SESSION <br />FOLLOWING THIS EVENING~S COUNCIL MEETING TO DISCUSS THE <br />SUPERIIMERICA LITIGATION <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (4) Morelan, Pedersen, Hanson, LaValle. <br />Nays (O). Resolution declared adopted. <br />1994 STREET The City Administrator reviewed the City Engineer's <br />IMPROVEMENT correspondence and bid tabulation for 1994 street <br />PROJECTS projects. Two bids were received, one from Ashbach <br />Construction and the other from Frattalone Excavating. <br />The Ashbach Construction bid was below the Engineer's <br />estimate for the projects, however, is higher than what <br />would normally be expected for this work. The <br />Administrator reported that the bidding market is not <br />conducive to work at this time since there is a lot of <br />work available for contractors. It was the <br />recommendation of the City Administrator that the bids <br />be rejected and that the projects be rebid at a later <br />date, possibly next February or March. The <br />Administrator reported that Statute 429 allows the <br />rejection of bids and a rebid of the project within one <br />year of ordering the project. If a contract is <br />approved prior to March 22, 1995, the City will be in <br />compliance with State Statutes for the improvements <br />contemplated. <br />The Administrator suggested that if the bids are <br />rejected, it be with the understanding that the <br />property owners would not be assessed any more for the <br />project than they would if this bid had been accepted. <br />The Administrator reported that in discussing the <br />matter with the City Engineer, it is their feeling that <br />new bids would come in 5 to 15 percent lower. However, <br />lower bids cannot be guaranteed. <br />The Administrator felt that rebidding the projects <br />would result in lower bids. The Administrator also <br />pointed out that if the bids were awarded, and the <br />projects started this year, they would not be completed <br />prior to school starting. There are a number of <br />children living in the Jackson/Old County Road <br />C/Lakeshore area, and it would be hazardous to have <br />school buses traveling through these construction areas <br />given the high amount of traffic.
