Under State
VIOLATION Statute, the City is also required to take action on
the violation.
The City Attorney reviewed his memo dated June 9th
regarding this matter pointing out that the City
Council must determine what action is necessary
relative to the violation and pursuant to the terms of
the ordinance. In that instance, the
Council imposed a$100 fine which was suspended should
no additional violations occur within a year.
Morelan asked the City's costs in prosecuting the
liquor license violation.
The City Attorney reported that the costs were covered
under the City~s retainer agreement with his office,
therefore, there were no additional costs to the City
relative to this case.
Mr. LaValle introduced the following resolution and
moved its adoption:
RESOLUTION NO. 94-7-167 - IMPOSING A$100.00 CIVIL
PENALTY IN THE SAXON LOUNGE/MINGLES' LIQUOR LICENSE
VIOLATION, AND SUSPENDING TI-IAT PENALTY IF THERE ARE NO
SUBSEQUENT VIOLATIONS OF A SIMILAR NATURE WITHIN ONE
YEAR
The foregoing resolution was duly seconded by Pedersen.
Ayes (4) LaValle, Pedersen, Hanson, Morelan.
Nays (0).
